The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
OWNER
Any individual, cooperative, public or private corporation, partnership, joint venture, association, personal representative, receiver, trustee, any unit or agency of government, or any equivalent entity, or any combination of them, which has a legal or equitable interest in the premises, which is shown as the record owner by the records of the Ottawa County Register of Deeds, or which has control of the premises. For purposes of this article, the owner shall be presumed to be the party shown on the Township tax rolls unless the enforcing official is notified in writing by a third party that such third party is the owner of the premises.
ROADWAY
Every public and private street, alley or easement which is utilized as the primary means of vehicular access to any premises located within the Township.

Any person who shall violate a provision of this article or shall fail to comply with any of the requirements thereof, shall be responsible for a municipal civil infraction.

The Township finds that on occasion emergency service workers, such as firefighters, emergency medical technicians and police, have been unable to locate a particular premises quickly because of the lack of a prominently displayed street number. To correct this problem, and to preserve and enhance the health, safety, and general welfare of persons and property and fire protection within the Township, the Township has adopted this article to require the prominent display of street numbers for each improved premises within the Township.

The following requirements pertaining to the numbering of premises shall apply to every premises within the Township which has a building located thereon:
(1) 
Every building located 100 feet or less from the edge of the roadway shall have Arabic numbers (0, 1, 2, 3, 4, 5, 6, 7, 8 and 9) not less than 3 3/4 inches high on the side of the building facing the roadway to which the address is assigned. The numbers shall be clearly visible and readable by the occupants of an emergency service vehicle while traveling in either direction on the roadway.
(2) 
Every building located more than 100 feet from the edge of the roadway but 200 feet or less from the edge of the roadway shall display numbers in accordance with subsection (1) of this section except that the numbers shall not be less than five inches in height. However, if numbers are displayed on a roadway post mailbox or sign in accordance with subsection (3) of this section, then the numbers are only required to be not less than 3 3/4 inches in height.
(3) 
Every building located more than 200 feet from the edge of the roadway, and any building for which the numbers required pursuant to subsections (1) or (2) of this section are not clearly visible and readable to the occupants of an emergency service vehicle while traveling in either direction on the roadway, shall have, in addition to the numbers specified in subsection (1) of this section, Arabic numbers not less than 3 3/4 inches in height displayed on a post, regulation United States Postal Service mailbox, or sign which is directly in front of the building or structure, on the same side of the roadway and not more than 10 feet from the edge of the roadway. The numbers shall be located at a minimum height of four feet, but not greater than six feet, above the ground level. If a sign is utilized to comply with the provisions of this subsection, the sign shall be in accordance with the provisions of the zoning regulations in Chapter 38 relating to signs as well as any other Township ordinance that regulates signs. The numbers shall be clearly visible and readable by the occupants of an emergency service vehicle while traveling in either direction on the roadway. If it is not obvious from the point where the numbers are located at the roadway which driveway serves the premises in question, then a second set of numbers shall be located, in accordance with the requirements of this subsection, which clearly identifies the driveway.
(4) 
Every residential, commercial, industrial or governmental complex having more than one principal building shall have its assigned street number displayed in accordance with subsection (3) of this section. In addition, each individual building in the complex shall have Arabic numbers displayed on the side of the building in such a manner as to be clearly visible and readable to the occupants of an emergency service vehicle while traveling in either direction on the roadway or on a private driveway on the premises. If the complex consists of duplexes or multifamily residential buildings, then each individual living unit shall have Arabic numbers not less than 3 3/4 inches high displayed on or near the front entrance to the living unit.
(5) 
Every building, while under construction, shall have temporary numbers displayed in accordance with subsection (3) of this section.
(6) 
The color of the Arabic numbers shall be in contrast to the immediate background to which they are affixed or inscribed. The numbers shall be displayed so as to be readily visible and readable during normal daylight hours. The numbers and the background to which they are affixed shall be constructed of a durable all-weather material.
(7) 
Subsections (1) through (6) of this section shall be construed to mean that, if the Arabic numbers as specified are hidden by an awning, overhang, or other obstruction, or if the numbers are not clearly visible or readable to the occupants of an emergency service vehicle traveling in either direction on the roadway or on a private driveway within a complex of buildings, then the owner or occupant of the building shall place supplementary Arabic numbers and/or letters in the manner reasonably determined by the enforcing official to best meet the intent of this article.
(8) 
All private streets approved by the Township shall have a name. A street sign shall be installed in a location determined by the enforcing official. The street sign shall meet the requirements of all Township ordinances and also the requirements of the Ottawa County Road Commission. In the event of a conflict between requirements of a Township ordinance and the requirements of the Ottawa County Road Commission, the requirements of the Ottawa County Road Commission shall control. All premises on the private street shall be numbered in the same general manner as premises are numbered on a public street.
(9) 
Building numbers may be spelled out for decorative purposes, however, Arabic numbers meeting the requirements of this article shall still be required.

The following provisions shall apply to the administration of this article:
(1) 
All applicants for a building permit for new construction shall be required to submit a "Request for Building Number" form. The Township shall assign a street number for all new construction. Each applicant shall agree to comply with provisions of this article as a condition of receiving the building permit. A building shall be numbered in accordance with the provisions of this article before any certificate of occupancy is granted pursuant to the zoning regulations in Chapter 38 and state construction code.
(2) 
The person charged with the responsibility to complete building inspections pursuant to the zoning regulations in Chapter 38 and state construction code shall initially be the enforcing official of this article. The Township Board, by resolution, may designate additional or alternate Township officials as the enforcing officials of this article.

(a) 
Whenever the owner of a building shall fail to comply with the provisions of this article, it shall be the duty of the enforcing official to serve or cause to be served on the owner a written or printed notice instructing the owner to properly affix numbers as provided in this article and to do so within 15 days of service of such notice. Such notice may be served in person or by certified mail, return receipt requested.
(b) 
In the event the owner neglects, fails or refuses to properly affix numbers as required by the provisions of this article within 15 days of the service of the notice specified in subsection (a) of this section, then the enforcing official shall properly affix or inscribe or cause to be properly affixed or inscribed the numbers required by this article.
(c) 
In the event the enforcing official affixes or inscribes or causes to be affixed or inscribed numbers on a building as is provided in subsection (b) of this section, the cost thereof, labor and materials, shall be assessed against the premises and shall then be billed and collected in the same manner as Township property taxes.
