A code regulating and controlling the location and construction,
alteration and operation of swimming pools, hot tubs and spas and
declaring and defining certain swimming pools as nuisances and fixing
penalties for violations is hereby adopted pursuant to Chapter 188,
P.L. 1950 (N.J.S.A. 26:3-69.1 to 26:3-69.6). A copy of said code is
annexed hereto and made a part hereof without inclusion of the text
thereof herein.
The code established and adopted by this chapter is described
and commonly known as the "Public Recreational Bathing Code" (N.J.A.C.
8:26-1 et seq., May 1991).
Three copies of said "Public Recreational Bathing Code" have
been placed on file in the office of the Secretary of this Board of
Health upon the introduction of this chapter and will remain on file
in said office for use and examination by the public.

There is hereby established the following schedule of fees for
permits and licenses, which shall be in addition to any other such
fees established by the Township of Morris or the State of New Jersey:
A.
Every public bathing place and recreational bathing place shall,
on or before June 1 of each year, pay to the Township of Morris an
annual license fee in the amount of $200 per pool, spa or whirlpool.
B.
Prior to the construction of a public bathing place or recreational
bathing place, the owner or applicant shall pay to the Township of
Morris a permit fee in the amount of $250 for plan review.
C.
Prior to the alteration of a public bathing place or a recreational
bathing place, the owner or operator shall pay to the Township of
Morris a permit fee in the amount of $150 for plan review.
A.
Any person or persons, firm or corporation violating any of the provisions
of this chapter or the "Public Recreational Bathing Code" made a part
hereof shall, upon conviction thereof, pay a penalty of not less than
$50 nor more than $1,000 for each violation.
B.
Each day a particular violation continues shall constitute a separate
offense.
The fees and charges hereinabove set forth shall not apply to
pools, spas or whirlpools owned and operated exclusively by organizations
or institutions which are exclusively charitable, religious, educational
or municipal.
This chapter and the code herein established shall take effect
30 days after the first publication of this chapter, in accordance
with the provisions of Chapter 188, P.L. 1950 (N.J.S.A. 26:3-69.1
to 26:3-69.6).
