A. 
The areas of the Village which are subject to periodic flooding as described by the Flood Hazard Boundary Map issued by the Federal Emergency Management Agency and as delineated on the Zoning Map are designated as a Flood Hazard Overlay District for the purposes of protecting human life, preventing material losses and reducing the cost to the public of rescue and relief efforts necessitated by the unwise occupancy of areas subject to floods.

B. 
In order to accomplish its purposes, this chapter uses the following methods with regard to the flood hazard area:
(1) 
Restrict or prohibit uses which are dangerous to health, safety and property due to water or erosion or in flood height or velocities.
(2) 
Require that uses vulnerable to floods, including facilities which serve such uses, be protected against flood damage at the time of initial construction.
(3) 
Control the alteration of natural floodplains, stream channels and natural protective barriers, which are involved in the accommodation of floodwaters.
(4) 
Control filling, grading, dredging and other development which may increase flood damage.
(5) 
Prevent or regulate the construction of flood barriers which will unnaturally divert floodwaters or which may increase hazards to other lands.
A. 
Within the Flood Overlay, no person shall erect, construct, enlarge, alter, repair, improve or move any permitted building or structure, nor shall any permitted activity such as mining, dredging, filling, grading, paving, excavation or drilling commence without first obtaining a certificate of compliance from the Building Inspector.
B. 
The Building Inspector shall review all applications for a certificate of compliance for activities within the flood hazard area and shall not issue a permit unless the following requirements are met:
(1) 
Construction or substantial improvement. New construction or substantial improvement of any structure shall either have the lowest floor, including basement, elevated to the level of the base flood elevation or, together with attendant utility and sanitary facilities, be floodproofed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water and with structural components having the capability of resisting hydrostatic and hydrodynamic loads and effects of buoyancy. A registered professional engineer or architect shall certify that the standards of this subsection are satisfied.
(2) 
Anchoring.
(a) 
All new construction and substantial improvements shall be anchored to prevent flotation, collapse or lateral movement of the structure.
(b) 
All temporary mobile homes shall be anchored to resist flotation, collapse or lateral movement by providing over-the-top and frame ties to ground anchors. Specific requirements shall be that:
[1] 
Over-the-top ties be provided at each end of the mobile home with two additional ties per side at intermediate locations and mobile homes less than 50 feet long requiring one additional tie per side;
[2] 
Frame ties be provided at each corner of the home with five additional ties per side at intermediate points and mobile home less than 50 feet long requiring four additional ties per side;
[3] 
All components of the anchoring system be capable of carrying a force of 4,800 pounds; and
[4] 
Any additions to the mobile home shall be similarly anchored.
(3) 
Construction materials and methods.
(a) 
All new construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage.
(b) 
All new construction or substantial improvements shall be constructed by methods and practices that minimize flood damage.
(4) 
Utilities.
(a) 
All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of floodwaters into the system.
(b) 
New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of floodwaters into the systems and discharges from the systems into the floodwaters.
(c) 
On-site waste disposal systems shall be located to avoid impairment to them or contamination from them during flooding.
