The terms and definitions therefor set forth in Chapter 1064 shall apply to this chapter and are incorporated herein as though set forth at length.

From and after passage of this chapter, and in accordance with the requirements of Chapter 1064, it shall be unlawful for any collector to collect any solid waste within Upper Providence Township unless and until such collector holds a valid license to do so and unless the collector complies with Chapter 1064. Licenses shall be issued annually by the Township Secretary and shall be valid only through December 31 of the year for which the license is issued or until revoked, whichever shall first occur.

No license shall be issued unless the person seeking such license
shall first pay to the Township Secretary the annual fee of $100 per
collector. Township Council shall have the power to amend the annual
fee by resolution from time to time.

No license shall be issued unless the person seeking such license shall have on file with the Township Secretary a current application (i.e. executed within 30 days prior to the date of issuance of the license sought) containing the following information: current business name, address and telephone number; current name of principal, partners or corporate officers and current address and signature of each; the license number of each vehicle collecting waste in the Township; the pick-up schedule of the collector; a statement that the collector shall comply with all applicable laws, including the Pennsylvania Solid Waste Management Act, 35 P.S. Section 6018.101, and Chapter 1064 of these Codified Ordinances; an agreement to indemnify and hold the Township harmless from any claims arising out of the collection of Municipal solid waste; and such other information as may be deemed proper by the Township Council to safeguard health and property.

No license shall be issued unless the Township Secretary shall
receive a certificate of insurance for the entire period in which
the license will be in effect, insuring against liability for bodily
injury (including death) and property damage under a policy of comprehensive
general public liability insurance, with such limits as may be reasonably
required by the Township, but not less than $500,000 for each occurrence
for bodily injury (including death) and $500,000 for property damage,
and, for each vehicle to be used in the collection of Municipal solid
waste, a certificate of vehicle liability insurance for the entire
period in which the license will be in effect in the minimum amounts
of $300,000 for bodily injury (including death) to one person in one
accident and $300,000 for property damage in one accident. Each policy
shall provide that it shall not be cancelable without at least 30
days prior written notice to the Township.

All trash trucks used in the Township shall have the license
number fixed in a prominent position on them, and a copy of the permit
in them.

If a collector fails to comply with all Township, County, State
and Federal laws regarding the collection and disposal of solid waste,
the Township shall, in addition to the imposition of fines and the
revocation of licenses, recover such costs and expenses as are incurred
in remedying the results and effects of the collector's violations.

All licenses shall be revocable at any time for cause shown
by the Township Secretary. The collector may appeal the revocation
to Council within 30 days of the date of the revocation.

Licenses are personal and are not transferable or assignable.

Each truck load or portion thereof of illegally collected or
delivered trash shall constitute a separate offense. A separate offense
shall also be deemed committed each day a collector operates without
a license.
