No person, group, or organization shall use the Village Hall
and Village Hall property unless such use is of a civic nature or
purpose. Under this section, a use shall have a "civic nature or purpose"
when citizens of the community seek primarily to benefit or enhance
the general welfare and common good of the Bannockburn community.
No person, group, or organization (other than bodies conducting
official business of the Village) shall hold any meetings or functions
of any kind in the Village Hall building without having first obtained
a Village Hall use permit from the Village.
A person, group, or organization seeking issuance of a Village
Hall use permit shall file an application with the Village at least
14 days before the date of the proposed event. The application shall
include:
A. The name of the person, group, or organization applying.
B. The purpose and description of the proposed use of the Village Hall.
C. The date and time for which the use is requested.
D. The expected attendance at the meeting or function.
E. Any special equipment or preparation which will be necessary and,
to the extent the Village is to provide such special equipment or
preparation, a cash deposit in an amount sufficient to cover the Village's
actual cost therefor.
F. The name, address, and telephone number of a contact person or representative
for the applicant.
G. A requirement that any applicant requesting a permit first obtain
general liability insurance, with a minimum coverage of $1,000,000,
naming the Village of Bannockburn as an additional insured. The applicant
shall produce to the Village a copy of such policy or other evidence
acceptable to the Village.
H. An agreement to waive and release the Village from any present or
future claims, causes of action, or damages that the applicant or
its individual members may have that arise out of, are connected with,
or relate to the use of the Village Hall and Village Hall property.
I. Any other information which the Village shall find reasonably necessary
to a fair determination as to whether a permit should be issued.
The Village President or the President's designee shall review
every application for a Village Hall use permit. If, upon review of
such application, a determination is made that the proposed use will
have a civic nature or purpose and that it will neither interfere
with official Village business, damage or harm the Village Hall, nor
violate any other ordinance of the Village, then the President or
the President's designee may issue a Village Hall use permit upon
such conditions as may be necessary or appropriate to protect the
public health, safety, and welfare of the Village and to preserve
and maintain the usefulness of the Village Hall.
The President or the President's designee may revoke any Village
Hall use permit upon a determination that:
A. Any of the information in a permit application was inaccurate or
incomplete;
B. Because of changed or unanticipated circumstances, the proposed use
will no longer satisfy the standards for permit issuance; or
C. The permittee has failed to perform any conditions of a Village Hall
use permit.
In the event that any Village Hall property is damaged during
any event permitted under this article, the permittee shall be responsible
to the Village for the full cost of repair or replacement of the damaged
property.
