Every officer of this City and his/her assistants and every Alderman, before entering upon the duties of his/her office, shall take and subscribe to an oath or affirmation before some court of record in Pemiscot County or the City Clerk that he/she possesses all the qualifications prescribed for his/her office by law; and that he/she will support the Constitution of the United States and the State of Missouri, the provisions of all laws of this State affecting Cities of the Fourth Class, and the ordinances of this City, and faithfully demean himself/herself while in office; which official oath or affirmation shall be filed with the City Clerk.
All officers elected to offices or appointed to fill a vacancy in any elective office under the City Government shall be voters under the laws and Constitution of this State and the ordinances of the City except that appointed officers need not be voters of the City. No person shall be elected or appointed to any office who shall at the time be in arrears for any unpaid City taxes, or forfeiture or defalcation in office. All officers, except appointed officers, shall be residents of the City.

Every officer shall, upon going out of office, deliver to his/her successor all books, papers and other things appertaining to his/her office.

The annual settlement of officers shall be made at the first (1st) regular meeting in April of each year. If any officer be delinquent with this City on such settlement or any other settlement made with the Board, the Mayor shall immediately order suit to commence against such delinquent officer or his/her bondsmen in the proper court for such balance.

All bonds executed to the City of Hayti by the officials of said City shall be filed and recorded in the office of the City Clerk, and any bond of any such official may be sued upon for any breach of condition of any such bond; such suit may be instituted by the City, or by any person in the name of the City of Hayti, to the use of such person.

The Mayor shall have power, as often as he/she or they may deem it necessary, to require any officer of this City to exhibit his/her accounts or other papers or records and to make reports to the Board of Aldermen, in writing, touching upon any matter relating to his/her office.
