The intent of this chapter is to minimize danger to public health and safety and damage to property by providing for management of storm water run-off in a manner consistent with the Act 167 Storm Water Management Plan for the Ridley Creek Watershed.

This chapter supersedes any other conflicting provisions which may be in effect in the Ridley Creek Watershed. However, any other ordinance provisions shall remain in full force and effect to the extent that those provisions are more restrictive. If there is any conflict between any of the provisions of this chapter, the more restrictive shall apply.

This chapter shall not create liability on the part of the Township or any officer or employee thereof for any damage that result from negligent enforcement or administration of this chapter's or any administrative decision lawfully made thereunder.

The Ridley Creek Watershed District shall not be deemed to be an independent district, but rather shall be deemed a district overlay. District boundaries shall be consistent with those indicated on the watershed release rate percentage map contained in the Act 167 Storm Water Management Plan for the Ridley Creek Watershed, which map is hereby made a part of this chapter by reference. If this chapter should be declared inappropriate to any tract by reason of amendment, special exception, variance or other order of the Township Council, Zoning Hearing Board or court of competent jurisdiction, the base zoning provisions applicable to such tract shall be deemed the governing provisions and shall be enforced independent of this chapter.

In addition to the regulations in underlying districts, all uses within the Ridley Creek Watershed District shall comply with the requirements and standards of the Act 167 Stormwater Management Plan (Act 167 and the provisions of the Ridley Creek Stormwater Management Ordinance of 1989 for the Township of Upper Providence).

No zoning permit or building permit shall be issued for proposed uses or construction in the Ridley Creek Watershed until the requirements and standards referenced under Section 1268.05 have been met.
