(a)
The BOCA National Building Code is hereby repealed save and except
the following provisions:
(1)
Section 111.5, Registration of contractors required (Added):
It shall be unlawful for any individual contractor, firm or corporation
to commence with any form of improvement to any property within the
Township without acquiring a contractor's registration. A contractor's
registration may be obtained at the office of the Township Secretary,
and the fee for such registration will be established by Council resolution
and may be amended from time to time.

Section 121.0, Means of Appeal is amended to read:
121.1 Application for appeal: An owner or other
person with a legal or equitable interest in the affected property
may appeal to the Board of Appeals from an adverse decision of the
code official. An application for appeal shall be based on a claim
that the true intent of this code has been incorrectly interpreted,
the provisions of this code do not fully apply or an alternative method
or material can be used, consistent with the health, safety and welfare
of the public. The appeal shall be in writing and served upon the
Township Secretary. The appeal shall cite the provision(s) of the
code for which the relief is requested and the reasons supporting
the request for relief. The code official shall file a written response
to the application for appeal with a copy to the appellant at least
seven days prior to the hearing.
121.2 Membership of Board of Appeals: The members
of the Township Planning Commission shall constitute the Board of
Appeals.
121.3 Hearings: Hearings on the appeals shall occur
at the next regularly scheduled Township Planning Commission meeting
occurring at least 22 days from the date the application for appeal
is filed or at such other time as the Board of Appeals establishes.
The hearing procedures shall be established by the Board of Appeals.
Recording and transcribing of testimony shall not be required.
121.4 Decisions of the Board of Appeals: The Board
of Appeals shall make decisions upon the majority vote of a quorum
of its members present and qualified to vote. The Board of Appeals
may make its decisions based upon the written application for appeal
with or without hearing.
121.5 Administration: The code official shall comply
with the decisions of the Board of Appeals.

Section 508.0, Stormwater Management is added to read:
508.1 General: The following stormwater management
provisions shall be applicable in the Township of Upper Providence.
508.2 System required: Every building in which
people live, work or congregate shall be provided with a stormwater
system which shall safely collect and release stormwater runoff from
building roof surfaces in accordance with the Pennsylvania Storm Water
Management Act No. 167.
508.3 Design: The design of each building's
stormwater system shall include those measures necessary to meet the
standards for stormwater release established in the Stormwater Management
Plan for the Ridley Creek Watershed.
508.4 Rooftop storage: Where rooftop storage is
being considered for stormwater detention purposes, storage volume
shall be designed according to criteria and standards adopted in the
Stormwater Management Plan for the Ridley Creek Watershed.
The design of large roof surfaces shall consider the storage
of precipitation on the roof structure in accordance with the criteria
and standards adopted in the Stormwater Management Plan for the Ridley
Creek Watershed.
508.5 Parking lots: Parking lots shall be graded
with rolled or compacted cinders, gravel or other approved materials,
including porous pavement, where feasible.
The design of parking lots shall consider seepage pits or basins,
detention basins, either aboveground or underground, among other methods
to control the rate of runoff from stormwater. The design of parking
lots shall ensure that runoff will be managed to adequately protect
health and property from possible injury.

Section 711.1 General (paragraph added): "Fire walls and party
walls separating residential dwelling units shall be of masonry construction
a minimum of eight inches in thickness. In the event that a dwelling
unit projects farther to the front or rear, or is taller than the
adjacent unit, these portions of the wall shall also be a minimum
of eight-inch thick masonry construction."

BOCA National Building Code not in conflict with the Uniform Construction
Code Act of 1999 as amended and contained in 34 PA Code, Chapters
401 - 405.
