(a) 
Upper Providence Township hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210, 1017210.1103, as amended from time to time, and its regulations.
(b) 
The Uniform Construction Code, contained in 34 PA Code, Chapters 401-405, as amended from time to time, is hereby adopted and incorporated herein by reference as the municipal building code of Upper Providence Township.
(c) 
Administration and enforcement of the Code within Upper Providence shall be undertaken in any of the following ways as determined by the Township Council from time to time by resolution:
(1) 
By the designation of an employee of the Township to serve as the municipal code official to act on behalf of the Municipality;
(2) 
By the retention of one or more construction code officials or third party agencies to act on behalf of the Township;
(3) 
By agreement with one or more other municipalities for the joint administration and enforcement of this Act through an intermunicipal agreement;
(4) 
By entering into a contract with another municipality for the administration and enforcement of this Act on behalf of Upper Providence;
(5) 
By entering into an agreement with the Pennsylvania Department of Labor and Industry for plan review, inspections and enforcement of structures other than one-family or two-family dwelling units and utility and miscellaneous use structures.
(d) 
A Board of Appeals shall be established by resolution of the Township Council in conformity with the requirements of the relevant provisions of the Code, as amended from time to time, and for the purposes set forth therein. If at any time enforcement and administration is undertaken jointly with one or more other municipalities, said Board of Appeals shall be established by joint action of the participating municipalities.
(e) 
(1) 
All building code ordinance or portions of ordinances which were adopted by Upper Providence Township on or before July 1, 1999, and which equal or exceed the requirements of the Code shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the Code, as amended from time to time. These ordinances or amendments are outlined in Ordinance No. 384.
(2) 
All building code ordinances or portions of ordinances which are in effect as of the effective date of this chapter and whose requirements are less than the minimum requirements of the Code are hereby amended to conform with the comparable provisions of the Code.
(3) 
All relevant ordinances, regulations and polities of this Municipality not governed by the Code shall remain in full force and effect.
(f) 
Fees assessable by the Municipality for the administration and enforcement undertaken pursuant to this chapter and the Code shall be established by the Township Council by resolution from time to time.

(a) 
Regulation of alterations and repairs to residential buildings. In addition to the minimum standards contained within the Act, the Township shall also enforce the International Residential Code 2021, as it applies to the alteration and repair of residential buildings, and property owners shall be required to obtain permits for all such alterations and repairs.
(b) 
Regulation of utility and miscellaneous use structures.
(1) 
In addition to the minimum standards contained within the Act, utility and miscellaneous use structures shall require permits as set forth in this section.
(2) 
Utility and miscellaneous use structures having a building area less than 200 square feet, and not containing any utilities, are exempt from all permitting requirements under the Act.
(3) 
Utility and miscellaneous use structures less than 200 square feet that contain utilities shall require permitting for those utilities. For the purpose of this section, a structure shall contain a "utility" if it has any connections to a source of natural gas, heating oil, electricity, sewer, or water or similar conveyances.
(4) 
All utility and miscellaneous use structures must comply with the various uniform codes that comprise the Pennsylvania Uniform Construction Code.
(5) 
All utility and miscellaneous use structures having a building area of 200 square feet or more must comply with all permitting requirements under the Act.
(c) 
Sanitary sewer regulations.
(1) 
Section 708 of the International Plumbing Code, is hereby supplemented.
(2) 
A two way clean out shall be required to be installed in addition to the guidelines detailed in section 708 of the International Plumbing Code.
