Regulation of parking has, at all times, remained within the
powers of municipalities, which, with the growth of the automobile,
have permitted parking along streets as a courtesy. The right of such
regulation has never been successfully challenged. Congestion on the
streets and growing inconvenience to residents, as well as the impeding
of normal and necessary traffic flow, have been the inevitable consequences
of the township's normal urban development. In the Township, this
condition has been heightened by the growth of business and populations
without provision for the necessary parking by the great number of
cars brought in by this growth. The situation has reached the point
where certain Township residents are unable to find parking near their
homes. Many of these people do not have garages and lack enough yardage
to construct parking. This most seriously affects our senior citizens
who are unable to shop or carry on other routine business for fear
of losing parking that they do have or of not finding parking upon
their return. Another point of increasing significance is the effect
on the environment of heavy vehicular traffic. The noise, dirt, litter
and pollution created by the thousands of cars that visit the Township
is unhealthy to the Township and its residents, both aesthetically
and physically. With all of this in mind, this chapter is designed
to increase the quality of life in the Township's more crowded sections;
to preserve the safety of children and other pedestrians; to promote
traffic safety and the peace, good order, comfort, convenience and
welfare of the inhabitants of the Township; to encourage commuters
to car pool or use mass transit; and to encourage those agencies and
establishments contributing to increased traffic to help promote additional
parking facilities.

As used in this chapter:
(a)
DWELLING UNIT — Means a single unit providing complete, independent
living facilities for one or more persons, including permanent provisions
of living, which normally include provisions for sleeping, eating,
cooking and sanitation, but which also include each room in a rooming
house.
(b)
HOLIDAY — Means New Year's Day, Lincoln's Birthday, Washington's
Birthday, Good Friday, Memorial Day, General Election Day, Veterans
Day, Thanksgiving Day and Christmas Day.
(c)
MOTOR VEHICLE — Means a vehicle which is self-propelled, except
one which is propelled solely by human power or by electrical power
obtained from overhead trolley wires but not operated upon rails.
(d)
PERSON — Means a natural person, firm, copartnership, association
or corporation.
(e)
PROFESSIONAL USE — Means restricted to the practice of medicine,
dentistry and law.
(f)
STREET — Means a way intended for general public use to provide
means of travel for vehicles and pedestrians. The word shall include
the words "road," "highway" and "thoroughfare."
(g)
VEHICLE — Means every device in, upon or by which any person
or property is or may be transported or drawn upon a highway, except
devices used exclusively upon rails or tracks.

The residential parking program (RPP) shall be as follows:
(a)
During the times set forth in subsection (b) hereof, no person shall be permitted to park a motor vehicle in, on or along the side of any Township street set forth in subsection (c) hereof and known as the "residential parking program area (RPPA)," unless there appears in a visible location on the rear bumper of said vehicle a parking sticker as provided in subsection (d)(1) hereof, or unless there appears in a visible location on the front dashboard of said motor vehicle a valid guest card as provided by paragraphs (d)(2) and (e)(2) hereof or a valid special card as provided by subsection (i) hereof.
(c)
The RPPA covered by this chapter shall be:
(1)
Mancil Road: 4:30 p.m. to 2:00 a.m. of the following day.
(2)
Shadeland Avenue: 6:00 a.m. to 12:00 a.m. of the following day.
(3)
Woodland Avenue: 6:00 a.m. to 6:00 p.m. daily.
(4)
Any other street, roadway, avenue or alley which the Council
may determine to include, by resolution, at any regular or special
meeting of Council.

The stickers or cards provided by this chapter shall appear and cost
as follows:
(1)
Stickers shall measure two by three inches, be blue on yellow
and cost $5 per year. The cost of said sticker shall be prorated by
calendar quarter.
(2)
Guest cards shall be prepared by the Police Department or any
other Township employee who may be designated by Council and shall
cost $1.50 each for the first two cards and $5 each for any additional
guest cards permitted by this chapter.
(e)
The eligibility for stickers or cards provided by this chapter shall
be as follows:
(1)
Stickers.
A.
Any person living in a residence abutting the streets in the
RPPA shall be entitled to receive a residential parking sticker, which
shall be nontransferable, if the applicant presents both proof of
residency in the RPPA and also proof of ownership of a motor vehicle
registered in the Commonwealth of Pennsylvania. Joint owners shall
be treated as one. Available at the Police Department shall be a list
of items and/or any combination thereof, which shall be approved by
Council and which shall constitute satisfactory proof of residence
in the RPPA.
B.
Owners and employees of businesses located in a building abutting
a street in the RPPA shall be entitled to a nonresidential parking
sticker, which shall be the same as a residential sticker, if the
applicant presents both proof of ownership of or employment by a business
in the RPPA or ownership of a motor vehicle. Joint owners shall be
treated as one. Available at the Police Department shall be a list
of items and/or any combination thereof, which shall be approved by
Council and which shall constitute satisfactory proof of ownership
of or employment by a business in the RPPA.
(2)
Guest cards.
A.
Each dwelling unit in the RPPA is eligible to be issued no more
than two guest cards. An applicant for guest cards must present proof
of residence as required by paragraph (e)(1) hereof. The Township
shall have no responsibility for the issuance of guest cards to any
particular resident of a dwelling unit.
B.
Each professional use shall be entitled to be issued up to five
guest cards. An applicant for guest cards for a professional use must
present proof of the location of the professional use in the RPPA
in accordance with the list in the Police Department as hereinbefore
set forth.
(f)
The only persons exempt from the provisions of this section shall
be:
(1)
Owners and operators of emergency vehicles while engaged in
an emergency or police activity.
(2)
Medical doctors on house calls in the RPPA.
(3)
Service vehicles, clearly labeled as such, during the time that
persons from said service vehicle are performing a service at a residence,
business or professional use in the RPPA.
(g)
When an enforcement officer has reason to believe that a guest card
is not being used in accordance with the purpose, intention and provisions
of this chapter, the Chief of Police shall be notified. The Chief
of Police shall then send a letter to the possessor of the subject
card, informing that person that the card is being used improperly.
If the violation or violations continue, the Police Department may
revoke the guest card(s), as long as the possessor of the same is
afforded an opportunity at an informal conference with the Chief of
Police to explain his or her position. If a guest card is revoked,
the possessor of the same shall deliver it to the Police Department.
Parking in the RPPA with a revoked guest card shall be the same as
parking with no guest card or residential sticker. Violators shall
be ineligible for a guest card issuance for one year.
(h)
The area known as the "RPPA" shall be posted with a minimum of two
signs per block, which signs shall read:

(i)
Special cards may be issued and used as follows:
(1)
Upon written application to the Police Department at least five
days in advance, special permission may be obtained for special cards
to be used for limited hours during special events.
(2)
Such application must note the purpose of the event, the date
and times, the number of vehicles expected and the name of the responsible
person to contact with respect to said event.
(3)
The Chief of Police shall grant up to a maximum of five special
cards for special events, as long as he or she finds that such action
will not pose a threat to the health, safety and welfare of the residents
of the Township of Upper Providence and the surrounding community
or create a serious inconvenience to other residents of the RPPA or
defeat its goals.
(4)
When permission is granted, the Chief of Police shall notify
the enforcement officers.
(5)
Special cards for special events which are distributed by the
Police Department are valid for no longer than 24 hours and shall
be so designated.
(j)
If a person sells his or her motor vehicle, he or she shall remove
the sticker and present it to the Police Department. If a replacement
vehicle is purchased, the old sticker may be exchanged for a new one.

Any person violating any of the provisions of this chapter shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$15, plus the cost of prosecution, or to imprisonment in the County
Jail for not more than five days, or both. It shall be the duty of
the enforcement officers of the Township to report all violations
of any provision of this chapter, indicating in each case the section
thereof violated, the license number of the vehicle involved in such
violation, the location where the violation took place, the time of
such violation and any other facts that might be necessary in order
to secure a clear understanding of the circumstances attending such
violation. The enforcement officer making such reports shall also
attach to said motor vehicle a notice that such vehicle was parked
in violation of this chapter, which notice shall contain instructions
to the owner or operator of such vehicle that if he or she shall report
to the Township and pay, for use by the Township, the sum of the fine
within seventy-two hours after the time of such notice, the same shall
save such violator from prosecution and from the costs attendant therewith.
