(a)
Definitions. As used in this section, the following definitions shall
apply:
(1)
MINOR — Means any person under the age of 18 years.
(2)
PARENT — Means any natural parent of a minor, a guardian
or any adult person 21 years of age or over who is responsible for
the care and custody of a minor.
(3)
PUBLIC PLACE — Means any public street, highway, road,
alley, park, playground, public building or vacant lot.
(4)
REMAIN — Means to loiter, loaf, wander, stroll or play
in or upon, whether within or without or upon a vehicle.
(b)
Establishment of curfew hours; certifications of employment.
(1)
No minor person shall be or remain upon any street, highway,
alley, park or public place within the Township after the hour of
10:00 p.m. and before the hour of 5:00 a.m. the following day, as
measured by the prevailing time, except that on Friday, Saturday and
Sunday evenings and the eve and day of any holiday as recognized and
established by Council, the restrictions shall apply at 11:00 p.m.
and remain until 5:00 a.m. of the following day. Such restrictions
shall be imposed unless the minor person is accompanied by his or
her parent or is in the performance of employment for which he or
she is receiving compensation or is returning from a recognized activity.
(2)
Council is authorized to issue certifications of employment
to employers of minor persons, which certifications shall be displaced
by minors when such minors are in a public place during the hour of
curfew restriction.
(c)
Responsibility of parent or guardian. It shall be unlawful for any parent of a person under the age of 18 years to allow or permit such minor person to be in or remain upon any of the streets, highways, alleys, parks or public places within the Township after the hours mentioned in subsection (b) hereof.
(d)
Enforcement. It shall be the duty of every police officer of the
Township, finding any minor person in or upon the public places within
the Township as aforesaid, to take the name of such minor and the
name and address of the parent of the minor, to send the minor home
or take other appropriate action and to make a report of the same
within eight hours to the Chief of Police. A written notice of the
violation, with due warning, shall thereupon be served or caused to
be served by the Chief of Police on the parent of the minor.
(e)
Responsibility of minor. Nothing herein is intended to relieve the responsibility of the minor person in the enforcement of this chapter. Minor persons violating the provisions of this section shall be subject to the provisions of Section 660.99.
(f)
Violations. If, after notice and warning, as provided in subsection (d) hereof, the minor is again found on or upon any of the streets, highways or public places in violation of this section, the parent shall be proceeded against upon the complaint of the Chief of Police or appropriate police officer before the District Justice of the Peace for the Township of Upper Providence.

Should a minor person who is in violation of Section 660.01 be between the age of 16 and 18, he or she shall, upon conviction for such violation, be subject to the penalty provided in Section 202.99(a) for each offense. Upon default in the payment of the fine and costs imposed upon such person, a notice of such fact shall be certified to the juvenile authorities of Delaware County.
