A. 
There shall be and is hereby established a Fire Department of the City of Pittston, which shall consist of as many engines, hoses, and hook and ladder companies as Council may from time to time authorize and appropriate funding for.
B. 
The Department shall be headed by a Fire Chief and such Assistant and Deputy Chiefs as the City Council may authorize.
The maximum membership in all companies shall be limited to 50 men. The minimum membership in all companies shall be 20 men. When the membership of any company falls below 20 men in good standing, such company shall be mustered out of the service by the Chief Engineer, whose duty it shall be to immediately take possession of all City property in the hands of such company and report the facts to Council at its first meeting thereafter.
The admission of members to the Department shall be subject to the choice of the company to whom application is made. The admission of companies to the Department shall be by ordinance of Council.
All independent or volunteer organizations not associated with the City Fire Department under the provisions of this chapter shall be subject to the rules and regulations hereof when on duty at fires within the City limits.
All property now owned, or that may hereafter come into possession of any company without cost to the City, shall be and is hereby declared to be private property and shall at no time be subject to control of Council or the officers of the Fire Department, except only as provided in § 36-4 of this chapter.
Each company shall always have the right to choose from their members in good standing such officers as may be necessary to maintain an efficient organization.
Each company shall keep, subject to the inspection of the Mayor, the Chief and District Engineers and the Fire Committee of Council, a roll book containing the names of every member of the company, when admitted, residence, and when he quit service.
It shall be the duty of the secretary of each company to make certified copies on the first of January of each year, together with a list of the company officers, and file one each of said copies with the Chief Engineer and with the City Administrator on or before the first Monday of February of each and every year.
