City of Pittston, PA Chapter 349 Parks and Recreation Areas

§ 349-1 Intoxicating beverages in parks.

A. A person commits an offense if he or she attempts to purchase, purchases, consumes, possesses or transports any alcohol, liquor or malt or brewed beverages within the confines of the parks, recreation areas or conservation areas within the limits of the City of Pittston without the prior permission of the City Council of the City of Pittston.

B. A person commits an offense if he or she openly consumes any alcohol, liquor or malt or brewed beverages on any public thoroughfare within the City limits of the City of Pittston without the prior permission of the City Council of the City of Pittston.

C. Permission procedure.

(1) For purposes of this chapter, the permission of Council may be received by applying in writing to the office of the City Administrator seven days prior to the date on which permission is requested. The City Administrator is hereby empowered to grant permission on behalf of the City Council of the City of Pittston.

(2) If the City Administrator denies permission to any individual or organization, said individual and organization may appeal the decision to the City Council. This appeal must be presented in writing and be considered by Council at a regular meeting or special meeting of the City Council of the City of Pittston.

(3) For the purpose of overturning the decision of the City Administrator, a simple majority vote of Council is required.

§ 349-2 Rules and regulations.

A. City Council may, by resolution, promulgate rules and regulations for conduct in the public parks.

B. A person commits an offense if he or she violates any of the rules and regulations as the same are posted in each of the parks and recreation areas within the limits of the City of Pittston.

§ 349-2.1 Designated handicapped parking in public parks and recreation areas.

In compliance with the Americans With Disabilities Act and to assure access for disabled persons, the Pittston City Streets and Sanitation Department, as directed by the City Administrator, shall install and maintain appropriate parking spaces marked for use exclusively by disabled persons in City parks and recreation areas. The Pittston City Police Department shall enforce the handicapped parking regulations within the City parks and recreation areas in the same manner and to the same penalties as proscribed for violation of the handicapped parking in § 340-5 of the Pittston City Code.

§ 349-3 Violations and penalties.

Any person violating any of the provisions of this chapter shall, upon summary conviction thereof in a summary proceeding before a Magisterial District Judge, be sentenced to pay a fine not to exceed $300, and costs. In default of payment of such fine and costs, such person shall be imprisoned in the county jail for a period not exceeding 90 days. Each and every day upon which any person violates or continues to violate the provisions of this chapter shall constitute a separate offense.
