1. It is the intent of this Part to establish rules and regulations
governing the use of conveyance systems and to establish penalties
in order to enforce said rules and regulations.
2. The rules and regulations governing the use of conveyance systems
are being established:
A. To set forth uniform requirements for the use of conveyance systems.
B. To prevent the introduction of groundwater into the sewer system.

The following terms, as used in this Part, shall have the following
meanings, unless the context clearly indicates a different meaning
is intended:
CONVEYANCE SYSTEMS
Any structures or facilities designed to collect, convey,
or discharge groundwater, including, but not limited to, downspouts,
sump pumps, and french drains.
GROUNDWATER
Stormwater, surface water, groundwater, well water, or water
from industrial or commercial air conditioning systems (residential
properties may have a ten gallon per day maximum discharge from air
conditioning systems).
PROPERTY OWNER
The legal or equitable owner of real property located in
Shrewsbury Township.
REAL PROPERTY
Any real property, including any structures erected thereon,
located within Shrewsbury Township.
SEWER SYSTEM
Any and all pipes, fittings, pumps, appurtenances, and facilities
that provide for the collection, conveyance, and treatment of waste
water from real property.

It shall be unlawful for any property owner of real property
to allow any ground water to drain or to enter into the sewer system.
No conveyance system of any type shall be connected or discharged
into the sewer system.

The Township's Code Enforcement Officer is authorized to enter
onto real property in order to inspect any structures thereon to confirm
that there are no conveyance systems discharging into the sewer system.
The following procedure for inspection of real property shall be as
follows:
A. At least 30 days prior to the inspection, the Code Enforcement Official
shall send written notice by certified mail, return receipt requested
and by first class mail, to the property owner of the date and time
that the Code Enforcement Officer intends to inspect the real property,
or, in the alternative, for the property owner to provide a certification
under paragraph .C, below.
B. At least 10 days prior to inspection, the Code Enforcement Official
shall attempt to contact the property owner by telephone to confirm
the date and time of the inspection. If the Code Enforcement Officer
is unable to reach the property owner by telephone, then the Code
Enforcement Office shall send a second notice by first class mail
advising the property owner of the date and time for the inspection
or, in the alternative, for the property owner to provide a certification
under paragraph .C, below.
C. In lieu of an inspection by the Code Enforcement Officer, a property
owner may, prior to the date of an inspection by the Code Enforcement
Officer, provide to the Code Enforcement Officer a certification from
a plumber licensed in the Commonwealth of Pennsylvania confirming
that the real property does not have any conveyance systems connected
to the sewer system.
D. The Township reserves the right from time to time to require inspections
or certifications for any real property to determine continued compliance
with the requirements of this Part.

It shall be a violation of this Part for any property owner
to:
A. Fail to comply with the provisions of this Part.
B. Refuse to permit an inspection of the real property, or fail to provide
a certification under § 18-804.C above.
C. Fail to remove any connection of a conveyance system to the sewer
system.

1. Any property owner who violates this Part shall upon summary conviction
before a District Magistrate be sentenced to pay a fine of not less
than $100 and not more than $1,000, plus the cost of prosecution and
in default of payment of any such fine shall be subject to imprisonment
in accordance with the Pennsylvania Rules of Criminal Procedure. Each
day that a violation continues shall constitute a separate violation,
and a violation of each Section of this Part shall constitute a separate
violation.
2. In addition to Subsection .1 above, the Township shall have the right
to pursue any and all remedies, legal or equitable, to abate any violation
of this Part.
