This Part shall be known as the "Shrewsbury Township Littering
Ordinance."

For purposes of this Part, the following terms shall have the
following meanings:
Waste paper, sweepings, ashes, household waste, glass, metal,
refuse, rubbish or any dangerous or detrimental substance. It shall
not include, however, refuse or garbage kept in a proper container
for purpose of prompt disposal.
The placement of any litter or permitting or authorizing
the placement of any litter into or upon any street, highway, alley
or upon the land of another or one's own land or into or upon any
public or private waters in Shrewsbury Township.

The presence of litter within Shrewsbury Township is hereby
declared to be a nuisance.

It shall be a violation of this Part for any individual, corporation,
partnership or other entity to engage in littering or permit property
owned by such individual, corporation, partnership, firm or other
business entity to be utilized so as to result in littering.

It shall be presumed that an individual, corporation, partnership,
or other entity whose name appears on items found in an accumulation
of garbage, trash or other discarded materials including, but not
limited to, bank statements, utility bills, bank credit card bills
and other financial documents is the owner of such litter and either
placed or authorized the placement of the litter at the location where
found. Advertising, marketing and campaign materials and literature
will not be sufficient to constitute a presumption of littering.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each Section of this Part which shall be found to have been violated
shall constitute a separate offense.

The Township' s parks shall be closed to the public between
dusk and dawn, prevailing time.

Practices and/or games or informal use of the fields shall be
cancelled if weather or field conditions are such that damage to the
grass or turf will result. If the fields are damaged, then the user
organization or individual responsible shall reimburse Shrewsbury
Township for necessary field repairs and, in addition, will lose field
use privileges for such time as determined by the Board of Supervisors.

Animals, as defined in Chapter 2 (Animals) of this Code are not permitted in Township parks.

All tobacco products, alcoholic beverages, and illegal substances
are prohibited.

Motorized vehicles are prohibited on grass surfaces at any time
for any reason, except for emergency vehicles.

It is prohibited to deface, remove, cut or damage any tree,
plant, shrub, turf, building, structure, sign or fixture, or any other
park component, unless authorized by the Board of Supervisors.

Open fires are prohibited, except that grills used for cooking
food are permitted. The use of grills is permitted only by persons
of legal age and a lit grill shall be attended at all times.

Activities such as golf, pitching horseshoes, archery or any
other activity that by its use may cause injury or damage to persons
or property are prohibited.

The use or discharge of firearms, slingshots, paintball guns,
BB guns, air pellet guns, or any other instrument or device that by
its use or discharge may cause injury or damage to persons or property
is prohibited.

Recreational or all terrain vehicles (ATVs) including, but not
limited to, snowmobiles, three- or four-wheelers, trail bikes, mini
bikes or motorcycles are prohibited.

Public, non-athletic gatherings involving more than nine people
are prohibited without prior written approval of the Shrewsbury Township
Board of Supervisors.

Threatening, abusive, insulting, profane or obscene language
or words, annoying, harassing or disorderly conduct, or immoral behavior
are prohibited.

Concession stands or the sale or solicitation of any item is
prohibited without the prior written approval of the Shrewsbury Township
Board of Supervisors.

Littering or the placement of any refuse outside of an approved
receptacle is prohibited. User organizations are responsible to pick
up all litter prior to departing from the park.

The park rules and regulations shall be enforced by the Pennsylvania
State Police or any other person or entity authorized by resolution
of the Shrewsbury Township Board of Supervisors.

For the enforcement of this Part by a law enforcement officer, the
procedures for the issuance of a citation to a defendant pursuant
to the Pennsylvania Rules of Criminal Procedure may be followed with
an initial fine of $50 per violation. In the event of an appeal of
the citation to the District Magistrate, and upon conviction thereof,
the defendant shall be sentenced to pay a fine not to exceed $1,000
per violation, or be sentenced to a term of imprisonment not to exceed
90 days under the Pennsylvania Rules of Criminal Procedure.

For the enforcement of this Part by any non-law enforcement officer,
the procedures for filing a summary criminal complaint shall be followed
and, upon conviction thereof, the defendant shall be sentenced to
pay a fine not to exceed $1,000 per violation, or be sentenced to
a term of imprisonment not to exceed 90 days under the Pennsylvania
Rules of Criminal Procedure.
