The purpose of this Chapter is to protect the safety and orderly development of the community through the regulation of signs and sign structures.

ANIMATED SIGN
A sign employing actual motion or the illusion of motion. Including electrical, environmentally, and mechanically activated.
BUILDING INSPECTOR
The City Building Inspector of the City of Marshfield, Missouri, or his or her designated representative.
CHANGEABLE SIGN
A sign with the capability of content by means of manual or remote input.
CLEAR SIGHT TRIANGLE
An area free of all obstructions that could interfere with the visibility of approaching drivers as defined in this Code.
COPY
The letters, figures, characters, pictures, or wording on a sign.
DESIGNATED HIGHWAY ZONE
A lot or portion thereof having frontage abutting Interstate-44 highway right-of-way or located within three hundred (300) feet of the interstate right-of-way.
DEVELOPMENT COMPLEX SIGN
A freestanding sign identifying a multi-occupancy development such as a shopping center or planned industrial park, which is controlled by a single owner or landlord, approved in accordance with Section 407.070 of this Chapter.
DIRECTIONAL SIGN
Any sign that is designed and erected for the purpose of providing direction and/or orientation for pedestrian or vehicular traffic.
ERECT
Attach, alter, build, construct, reconstruct, enlarge, or move.
FLAG
A construction of fabric, plastic or paper depicting through symbols, characters, design or letters a nation, political subdivision, or business when hung, without frame, from a staff or pole. A flag does not include wind signs such as streamers, banners, or pennants.
FLASHING LIGHT
A continuously intermittent light or sequential light.
IDEOLOGICAL AND NON-COMMERCIAL SIGNS
A sign which does not name or advertise a product, service or business but only expresses a viewpoint, non-commercial message, opinion, or idea. This includes commemorative plaques, historic makers, holiday decorations, political or fraternal flags or emblems, or protective signs which are commonly associated with safeguarding the permitted uses of a premise, including, but not limited to, "vicious dog," "no trespassing," "neighborhood watch," and "authorized parking."
LIGHT POLE BANNER
A banner sign stretched vertically between two (2) horizontal pole extensions that are attached to a light pole or utility pole.
LOT
A parcel of land under one (1) ownership designated as a separate and distinct tract.
MONUMENT SIGN
A sign supported by the ground and not attached to a building or structure, and where the bottom edge of the sign structure is on or in the ground. A multi-tenant monument sign is a monument sign permitted for a property with three (3) or more tenants, as identified by individual tenant addresses.
MURAL
A large picture painted or affixed directly on an exterior building wall or solid fence.
OFF-PREMISES SIGN
Any sign advertising products, services, uses, or enterprises sold, produced, offered, manufactured, or furnished at a location other than the property where the sign is physically located.
OUTDOOR ADVERTISING SIGN
A sign erected, maintained, or used in the outdoor environment for the purpose of the display of commercial or non-commercial messages not appurtenant to the use of, products sold on, or the sale or lease of, the premise on which it is displayed.
POLE SIGN
A sign which is supported by one (1) or more uprights, poles, or braces affixed to the ground, and not attached to a building or structure.
POLITICAL SIGN
A temporary sign intended to advance a political statement, cause, or candidate for office.
PORTABLE SIGN
Any sign not permanently attached to the ground or to a building surface.
REAL ESTATE SIGN
A temporary sign advertising the sale, lease or rental of the property or premise upon which it is located.
ROOF SIGN
A sign erected on a roof, including a mansard type roof, where any portion of the sign extends above the roofline of a building or structure, or that is mounted upon the horizontal plane of a flat roof structure, which may include the roof of a canopy that is attached to a building.
SUBDIVISION SIGN
A monument sign located at the entrance of and identifying the name of a legally platted subdivision of land.
SWING SIGN
A type of temporary sign that is suspended from a horizontal swing post which is attached to a post that is staked into the ground.
WIND BLADE SIGN
A piece of cloth or other similar material, varying in size, color, and design, that is attached to a pole or staff, and may be in the shape of a vertically oriented rectangle, teardrop, or similar, where typically the cloth or material is supported by wire to maintain the shape of the flag.
WINDOW SIGN
A solid or transparent sign painted on or affixed to either side of a window or facing the outside and intended to be seen from the outside.
YARD SIGN
A type of temporary sign that is constructed of paper, vinyl, plastic, wood, metal or other comparable material, which is mounted on a stake or a frame structure (often made from wire) that includes one (1) or more stakes.

A. 
Conformance To Codes. Any sign hereafter erected shall conform to the provisions of this Chapter and the provisions of Chapter 500, Article I, International Building Code, and of any other applicable provisions of this Code or any regulations promulgated hereunder.
B. 
Permits Required. All signs allowed by this Chapter shall require a permit issued by the Code Official unless exempted per Section 407.040.
C. 
Signs in Right-of-Way. No sign other than a traffic, directional or promotional sign authorized by the appropriate governmental agency, shall be erected within any public way, unless specifically authorized by ordinance, resolution, or regulation of the City of Marshfield.
D. 
Projections Over Public Ways Or Upon Public Property. Projecting signs over public walkways shall be allowed to do so only subject to the projection clearance limit at a minimum height of eight (8) feet from grade level to the bottom of the sign. No sign may be placed in, upon or projecting over property owned, leased, or managed by the City, including, but not limited to, rights-of-way without prior authorization from the City.
E. 
Traffic Visibility. No sign or sign structure shall be erected at the intersection of any street in such a manner as to obstruct free and clear vision, or at any location whereby its position, shape, or color it may interfere with or obstruct the view of or be confused with any authorized traffic sign, signal or devise.
F. 
Computation Of Frontage. If a premise contains walls facing more than one (1) property line or encompasses property frontage bounded by more than one (1) street the sign area (s) for each building wall or property frontage will be calculated separately for each building wall or property line facing a different frontage. The sign area(s) calculated shall be permitted to be applied to permitted signs placed on each separate wall or property line frontage.
G. 
Animation And Changeable Messages. Animated signs, changeable signs, except those that blink, flash or are animated by lighting in any fashion that would cause such signs to have the appearance of traffic safety signs and lights or municipal vehicle warning from a distance, are allowed for non-residential uses in all districts.
H. 
Maintenance, Repair And Removal. Every sign allowed by this Chapter shall be kept in good condition and repair. When any sign becomes insecure, in danger of failing or is otherwise deemed unsafe by the Code Official, or if any sign shall be unlawfully installed, erected or maintained in violation of any of the provisions of this Chapter, the owner thereof or the person or firm using same, shall, upon written notice by the Code Official forthwith, in the case of immediate danger, and in any case within not more than ten (10) working days, make such sign conform to the provisions of this Chapter, or shall be permitted to remove or cause such sign to be removed at the expense of the owner and/or the user of the sign.
I. 
Obsolete Sign Copy. Any sign copy that no longer advertises or identifies a use conducted on the property on which said sign is erected must have the sign copy covered or removed within thirty (30) calendar days after written notification from the Code Official; and upon failure to comply with such notice, the Code Official is hereby authorized to cause removal of such sign copy, and any expenses incident thereto shall be paid by the owner of the building, structure or ground which the sign is located.
J. 
Non-Conforming Signs. Any sign legally existing at the time of the passage of this Chapter that does not conform in use, location, height or size with the regulations of the property use in which such sign is located shall be considered a legal non-conforming use or structure and shall be permitted to continue provided that it is maintained in good condition, but cannot be:
1. 
Structurally altered (except to meet safety requirements).
2. 
Altered to increase the degree of non-conformity of the sign.
3. 
Expanded.
4. 
Moved or replaced except to bring the sign into complete conformity with this Chapter.
5. 
Reconstructed after damage if the cost exceeds fifty percent (50%) of the value (appraised or tax value) of such sign.
6. 
Abandoned or discontinued for a continuous period of one hundred eight (180) days.

A. 
The following signs shall not require the issuance of a sign permit but must be in conformance with all other sign regulations and the Building Code. These signs are allowed in addition to all other signs allowed.
1. 
Address Numbers And Name Plates. Address numbers for each residential building and building address numbers not exceeding one (1) square foot in effective area per character, and one (1) name plate not exceeding two (2) square feet in effective area per dwelling unit or business.
2. 
Banner Signs. One (1) sign composed of highly flexible lightweight materials, such as a banner, per business premises, which is not over twenty-four (24) square feet in effective area, posted for not more than one hundred eighty (180) days per year.
3. 
Flags. Flags of any nation, State or political subdivision provided.
a. 
The flag is located in such a manner that no portion of the flag will project over any property line or contact any other structure when fully extended.
b. 
If the flag is flown from a flagpole, such flagpole shall be a minimum of four (4) times the length of the flag but shall not exceed over sixty (60) feet in height from finished grade.
4. 
Government Signs. Any sign erected or maintained by or for any agency of government pursuant to and in discharge of any governmental function or required or authorized by law, ordinance, or governmental regulations. Government signs may be placed on utility poles or light poles with the permission of the owner(s) thereof.
5. 
Holiday Decorations. Holiday decorations in season.
6. 
Internal Signs. Any on-premise sign where the copy of which can not be viewed from a street right-of-way or adjoining property.
7. 
Real Estate Sale, Lease And Construction Signs. Detached or attached non-illuminated temporary on-premise sign pertaining to the construction, sale or lease of the premise, not to exceed sixteen (16) square feet in effective area in business areas and not to exceed four (4) square feet in effective area in non-business areas. Such signs shall be removed within fourteen (14) days after the closing of the sale or lease or within thirty (30) days after the issuance of an occupancy permit or erection of a permanent sign, whichever occurs first.
8. 
Miscellaneous Exempt Signs. Including "no trespassing," "beware of dog" advertising drives or events of a civic, philanthropic, educational, religious, political, or similar nature, garage sales complying with Chapter 620, incidental signs which pertain to goods, products, services, or facilities related to the main activities or purpose of the business, not exceeding a total of four (4) square feet in effective area per business.
9. 
Murals. Murals painted or affixed directly on an exterior building wall or solid fence with express owner permission and without advertisement or sponsorship.
10. 
Business. Any business may have one (1) freestanding sign, not exceeding six (6) square feet, to advertise their business.

A. 
This Section applies to all sign types and classifications, including permanent and temporary signs.
1. 
Sign Area.
a. 
The maximum total signage permitted per property in the Neighborhood Commercial District ("B-1"), Central Business District ("B-2") General Business District ("B-3"), Light Industrial district ("I-1") and Heavy Industrial District ("I-2") is fifteen (15) square feet of signage per one (1) lineal foot of building frontage.
b. 
The area of a two-dimensional sign is measured by encompassing the advertising display surface area within a single rectangle that would enclose all parts of the sign.
2. 
Height And Clearance. The permitted maximum height for all signs is determined by the sign type. Sign height and clearance is measured as follows:
a. 
Freestanding Sign Height. The height of a freestanding sign shall be computed as the distance from the base of the sign at existing finished grade to the top of the highest attached component of the sign.
b. 
Sign Clearance. Clearance for freestanding and projecting signs shall be measured as the smallest vertical distance between finished grade directly underneath the sign at the lowest point of the sign structure, including any framework or other structural elements.
c. 
Sign Spacing. Required sign spacing between signs on a single property shall be three hundred (300) feet as measured along lot frontage.
3. 
Clear Sight Triangles.
a. 
Calculation.
(1) 
An intersection clear sight triangle is located at an intersection between two (2) streets. The area is a triangular-shaped piece of land, measuring forty (40) feet in distance along arterial and collector streets and twenty (20) feet in distance along residential streets, both distances being measured from and along the back of the curb, and vertically by measuring between three (3) feet and ten (10) feet above grade.
(2) 
A driveway clear sight triangle is located at an intersection between an entrance or drive and a street. The area is a triangular-shaped piece of land, measuring fifteen (15) feet in distance along the street and fifteen (15) feet in distance along the entrance or drive, both distances being measured from and along the back of the curb, and vertically by measuring between three (3) feet and ten (10) feet above street grade.
b. 
Sign Placement. Signs may be erected within the clear sight triangle as follows:
(1) 
Signs within an intersection clear sight triangle shall not be between three (3) feet and ten (10) feet above street grade, except for supports which may not exceed one (1) foot in width or diameter or be spaced less than ten (10) feet from any other stationary object.
(2) 
Signs within a driveway clear sight triangle shall not be between three (3) feet and ten (10) feet above street grade except for supports which may not exceed one (1) foot in width or diameter or be spaced less than ten (10) feet from any other stationary object.
c. 
Landscaping And Visual Obstructions. Landscaping and visual obstructions, including but not limited to fences and access point signs, shall be three (3) feet or less so as not to encroach into the clear sight triangle.

A. 
Agriculture District ("A").
1. 
The maximum total signage permitted per property in the Agricultural district is sixty-four (64) square feet per public roadway frontage.
2. 
All square footage must be allocated to a single sign on that frontage and cannot be aggregated with permitted square footage from other frontages.
B. 
Residential Districts ("R-1," "R-2," "R-3" and "R-4"). Table 407.060.1 identifies the types of signs permitted in the "R-1," "R-2," "R-3" and "R-4" Residential Districts, and their regulations. If a sign type is not included in Table 407.060.1, it is not permitted in the residential districts.

If a sign type is not included in the appropriate table, it is not permitted in the Neighborhood Business and Central Business Districts. Residential uses in these districts are limited to dwelling unit wall signs.

A. 
Purposes. The purposes of the temporary sign regulations are as follows:
1. 
Enhance opportunities for visual communication, including promoting the legibility of such communications;
2. 
Create a more attractive economic and business climate within the City;
3. 
Enhance and protect the physical appearance of all areas of the City; and
4. 
Reduce the distractions, obstructions, and hazards to pedestrian and automobile traffic caused by the excessive number, size, or height, inappropriate means of illumination or movement, indiscriminate placement, overconcentration, or unsafe construction of signs.
B. 
Allowed On Private Property Restrictions. Temporary signs, including, but not limited to, those specified within this Chapter are allowed on private property provided they meet the following requirements:
1. 
The sign conforms to all requirements of this Chapter;
2. 
The sign does not interfere with automobile traffic or pedestrians;
3. 
The sign is not placed in the public right-of-way or on public property;
4. 
When a sign placed on private property, is done with the express permission of the property owner; and
5. 
The sign is not a public danger or nuisance during high winds or inclement weather.
C. 
Permits and Standards.
1. 
Required. A temporary sign permit is required unless otherwise specified within this Chapter.
2. 
Display duration.
a. 
Unless otherwise defined within this Chapter, the display of temporary signs shall be limited to a maximum of thirty (30) days per address, cumulative total per calendar year. A calendar year begins January 1 and ends December 31.
b. 
The 30-day per address cumulative total per calendar year requirement shall be restarted when a business at a specific address changes ownership within any given year.
3. 
Number Of Signs. Unless otherwise specified in this section, a maximum of one (11) temporary sign shall be allowed per address at any time.
4. 
Printing And Placement. Signs may be printed on both sides or two-single sided banners may be placed back-to-back. V-type configurations are not allowed.
5. 
Permit Sticker. A permit sticker will be provided and shall be placed on the sign where visible.
6. 
Temporary signs shall not be used as a method to circumvent the regulations that apply to permanent signs, or to add a permanent sign to a parcel in addition to the permanent signage permitted on that parcel.
7. 
Temporary signs shall not be illuminated.
8. 
Temporary signs shall not contain any digital components, or a changeable message component or mechanism.
D. 
Location.
1. 
Unless otherwise specified within this Chapter, temporary signs may only be placed on the parcel for which the temporary sign permit is issued.
2. 
Except in the Downtown District, all temporary signs shall be located on private property or within four (4) feet from the building facade. When property lines are not easily identifiable, signs shall be placed on the non-street-side of any sidewalk. If no sidewalk exists, a minimum of ten (10) feet from the edge of street pavement or back of curb, beyond any visible utility including overhead powerlines, fire hydrants, or utility junction boxes is required.
3. 
A-frame signs shall be located within ten (10) feet of the sign owner's business entrance and shall be removed when the business is closed and during severe weather events. To preserve the pedestrian pathway, in no case shall an A-frame sign reduce the resulting sidewalk width to less than five (5) feet.
E. 
Removal. Temporary signs shall be subject to removal as provided in this Chapter.

A. 
Sign Types.
1. 
A-Frame Sign. A sign consisting of two (2) sign faces placed together at an angle of ninety degrees (90°) or less to form an "A" shaped structure that tapers from a wide base to a narrow top.
2. 
Banner Sign. A sign constructed of plastic or fabric of any kind that is attached to supports, a frame, or a flat surface, including wind blade signs.
3. 
Yard Sign. A sign placed upon or supported by the ground, independently of any other structure, but not including an A-frame sign.
B.

Exceptions and Additions to Table 407.070.1.
1. 
A-frame signs may be placed on the public sidewalk in the Central Business District ("B-2") district directly in front of the business but shall be placed so they do not interfere with or impede the flow of pedestrian movement.
2. 
Active real estate listing or active building permit signs. One (1) additional temporary sign is permitted on a property that is subject to: (a) an active real estate sale or rental listing; or (b) active building permit. The sign may remain posted on the site for the duration of the listing period or while the building permit is valid and active. The dimensional standards of Table 407.070.1 shall apply by district. No permit shall be required.
3. 
Pennant Signs. Pennant signs shall be allowed in the "B-3" General Business District when placed at a height to allow for vehicle clearance but no less than ten (10) feet from grade.
D. 
General Provisions.
1. 
Temporary signs may be allowed as part of a special event or temporary use permit pursuant to this Subsection.
a. 
Maximum Sign Calculation. Temporary signs permitted through a special event or temporary use permit may be off-premises with the permission of the property owner, and may be allowed on a parcel in addition to the maximum amount of temporary signage permitted on that parcel.
b. 
Temporary Sign Types. Temporary signs permitted as part of a special event or temporary use permit are restricted to the types, sizes, and heights identified in Table 407.070.2 unless otherwise specified in this Subsection.

Election Event. For a period of 60 days prior to a state, local, or national election, the total number of temporary signs permitted per property may be increased over the maximum amount of temporary signage permitted by this Chapter. The dimensional standards of Table 407-070.1 shall apply by district. No permit shall be required.
3. 
Garage/yard sale event. Temporary signs may be permitted in conjunction with a permitted garage/yard sale as follows:
a. 
Signs shall be located within a 1-mile radius of the garage/yard sale.
b. 
Signs may be displayed up to twenty-four (24) hours prior to the garage/yard sale.
4. 
Open house/auction event. Temporary signs may be permitted in conjunction with a staffed real estate open house/auction as follows:
a. 
Signs shall be located within a 1-mile radius of the open house.
b. 
Signs may be displayed up to forty-eight (48) hours prior to the open house/auction event and shall be removed within four (4) hours of the conclusion of the event.
E. 
Temporary Substitute Signage For Damaged Permanent Signs. In the event that a permanent sign is substantially damaged through fire, natural disaster, or similar emergency, or in the case of major construction projects, where existing permanent signage is removed for construction purposes, a temporary sign may be allowed for a period of time not exceeding sixty (60) days. Temporary signage is limited to a maximum of thirty two (32) square feet per address, unless the temporary signage is affixed to any wall face of the main structure. In no case shall any temporary signage exceed a maximum size of two hundred fifty (250) square feet.

A. 
Non-Conforming Signs.
1. 
Where a lawful sign exists at the effective date of adoption of the ordinance from which this Chapter is derived, or amendment of this Chapter, that would be illegal under the terms of this Chapter, such sign may be continued so long as it remains otherwise lawful, subject to the provisions of this Section.
2. 
Any proposed change to a non-conforming sign, excluding general repairs, maintenance and advertising copy, shall require the sign to be brought into conformance with this Chapter.
3. 
No such non-conforming sign or sign structure may be altered in any way that increases its non-conformity.
4. 
Alternations to a non-conforming sign or sign structure may be made, provided that the alterations eliminate its non-conformity.
5. 
When a permit has been obtained, temporary removal of any portion of a sign for repairs or general maintenance shall not be considered to be in violation of this Chapter, provided that no alterations are made to the sign or sign structure.
6. 
Should such sign or sign structure be moved for any reason and over any distance whatsoever, it shall thereafter conform to all regulations for the distance in which it is located after it has been moved or relocated. Any sign temporarily removed by a public utility company, the City, or any governmental agency to accommodate repair or maintenance, or expansion operations may be replaced, provided that there is no change in size, height, or location of the sign.
7. 
If any sign is moved as a direct result of a public street expansion, it may be relocated to a position determined by the City Engineer to be appropriate in relation to the expansion project, and such a sign shall not be considered non-conforming for the reason of separation. No permit shall be required for such replacement.
B. 
Loss of Non-Conforming Status. A legal non-conforming sign shall lose such designation if any of the following apply:
1. 
The sign is removed, relocated, or replaced for any reason except towards compliance with this Chapter.
2. 
If greater than fifty percent (50%) of a non-conforming sign, as measured by replacement cost of both the sign and structure prior to such destruction, is damaged by any means, it shall be considered destroyed and shall not be brought back into service or use except in conformity with the provisions of this Chapter.

A. 
Unlawful Acts. It shall be unlawful for any person, firm, or corporation to erect, construct, alter, extend, expand, repair or move any sign, structure or equipment regulated by this Chapter, or cause same to be done in conflict with or in violation of any of the provisions in this Chapter.
B. 
Notice Of Violation. The Code Official is authorized to serve a notice of violation or order on the person responsible for a violation of the provisions of this Chapter or in violation of a permit or certificate issued under the provisions of this Chapter. Such order shall direct the discontinuance of the illegal action or condition and the abatement of the violation within a specified, reasonable period of time.
C. 
Prosecution Of Violation. If the notice of violation is not complied within the time specified in the notice of violation, the Code Official is authorized to issue a citation to institute the appropriate proceeding at law or inequity to punish, restrain, correct or abate such violation.
D. 
Removal Of Temporary Signs. In the event that the violation as set forth above consists of signage that has been placed and does not meet the requirements within this Chapter, the Code Official is hereby authorized to remove said signage and to notify the owner how and when the signs can be retrieved. If the owner of said signs cannot be determined or, after due notice, the owner fails to retrieve the signs, then the Code Official is authorized to dispose of said signs after a reasonable period of time.
E. 
Penalties. Any person, firm or corporation found responsible for a violation of this Chapter shall be punished as provided in Section 100.240 of this Code.
