The administrative powers and functions of the government of the Township of Mine Hill shall be vested in and exercised by the Mayor, the departments of the Township government hereinafter specified, the Business Administrator, the department heads, the officers and employees of each department hereby established, and the statutory, independent, quasi-independent and advisory boards, agencies and commissions hereinafter described and set forth in Article XIII, Statutory and Independent Boards, Agencies, Commissions and Committees, of this chapter.
A. 
Term. The Mayor shall be elected by the voters of the Township at the general election held in November. The Mayor shall serve for a term of four years commencing January 1 next following his (her) election.
B. 
Compensation. The Mayor shall receive compensation as provided in § 7-14A.
C. 
Duties. The Mayor shall be the chief executive and administrative officer of the Township and shall:
(1) 
Enforce the Charter, this Code and other ordinances of the Township and all general laws applicable thereto.
(2) 
Supervise all of the departments of the Township government.
(3) 
Require each department to make a written annual report and such other reports of its work as he (she) may deem desirable.
(4) 
Appoint the Business Administrator and all other department heads, with the advice and consent of the Council.
(5) 
Unless otherwise specified by this Code, other ordinances of the Township, the Charter or general law, appoint members of boards, agencies and bodies and other officers and employees, all subject to the advice and consent of the Council.
(6) 
Submit an annual budget to the Council on or before January 15, together with such explanatory comment or statement as the Mayor may deem desirable.
(7) 
From time to time, make such recommendations for action by the Council as the Mayor may deem in the public interest.
(8) 
Report annually at the beginning of the year to the Council and the public on the work of the previous year and the condition and requirements of the Township government for the current year.
(9) 
Approve all ordinances adopted by the Council, or allow them to take effect without Mayoral approval, or exercise the veto power of the Mayor.
(10) 
Attend meetings of the Council and take part in discussions without vote, provided the Mayor, within the Mayor's sole discretion, elects to so attend and take part in discussions.
(11) 
Cast the deciding vote in the event of a tie on the question of filling a vacancy on the Council.
(12) 
Within the discretion of the Mayor, may remove the Business Administrator or any other department head, after notice and opportunity to be heard. Prior to removing a department head, the Mayor shall first file written notice of his (her) intention with the Council, and such removal shall become effective on the 20th day thereafter, unless the Council shall, prior thereto, have adopted a resolution by the affirmative vote of four of its members, disapproving such removal.
(13) 
Assign and reassign, transfer and retransfer, from time to time, either temporarily or permanently, any property or any officer or employee of the Township from one function or assignment to another or from one administrative department, division or unit to another as the management and operation of the Township may require, subject to the express requirements of the Charter, this Code and all other applicable ordinances of the Township and general laws.
(14) 
Have such other functions, powers and duties as are provided by Charter, ordinance or general law.
(15) 
In the absence of the appointment of a Director of Public Safety, serve as the "appropriate authority" to whom the Chief of Police reports, pursuant to N.J.S.A. 40A:14-118. As the "appropriate authority," the Mayor may adopt and promulgate rules and regulations for the governing of the force and for the discipline of its members.

D. 
Interim appointments. Whenever a vacancy exists in any office required by general law, the Charter, this Code or other ordinances to be filled by the Mayor with the advice and consent of the Council, the Mayor may temporarily fill such vacancy, in the absence of any contrary provision in the Charter, this Code or other ordinances or laws, by appointing an acting officer, including the designation of himself (herself) as an acting department head (including Business Administrator) in the event of a vacancy in such office. Such appointee shall have all of the functions, powers and duties of the office until it shall be filled permanently. Any such appointment shall terminate not later than 60 days after the date of the appointment, unless the Council shall by resolution authorize one or more extensions of such period. Whenever any such vacancy exists in any office as contemplated by this section, the Mayor shall make nominations to fill such office and transmit the same to the Council for its advice and consent no later than 60 days from the date such vacancy occurred, unless the Council shall by resolution authorize one or more extensions of such period.
E. 
Mayor as permanent department head prohibited. Except as provided in Subsection D regarding interim appointments, the Mayor shall not designate himself (herself) nor appoint himself (herself) the department head of any department, except the Mayor with the advice and consent of the Council may appoint himself (herself) the department head (Director) of the Department of Planning and Development.
F. 
Acting Mayor. As provided by the Charter (N.J.S.A. 40:69A-42), the Mayor shall designate the Business Administrator, any other department head or the Township Clerk to act as Mayor whenever the Mayor shall be prevented by absence from the Township, disability or other cause from attending to the duties of his office. During such time, the person so designated by the Mayor shall possess all the rights, powers and duties of the Mayor. Whenever the Mayor shall have been unable to attend to the duties of his office for a period of 60 consecutive days, for any of the above-stated reasons, an Acting Mayor shall be appointed by the Council, who shall succeed to all the rights, powers and duties of the Mayor or the then-Acting Mayor.[1]

G. 
Delegation of powers. The Mayor may delegate to the Business Administrator, or any other department head, any functions, powers or duties of the Mayor which are not required by the Charter, this Code, general law or other ordinances of the Township to be discharged personally by the Mayor.
