There shall be a Department of Health, the head of which shall
be the Director of Health. The Department of Health shall consist
of the following divisions:
The Director of Health shall be appointed by the Mayor with
the advice and consent of the Council for the term of the Mayor appointing
him (her) and until a successor has been appointed and qualified.
The Director of Health shall receive such compensation as shall be
fixed annually by ordinance. The head of the Division of Health (Health
Officer) may, but need not be, also appointed Director of Health.

Board of Health abolished. The Department of Health shall perform
all the administrative and executive functions relating to health
and welfare formerly carried out and performed by the Board of Health
of the Township of Mine Hill prior to change in its form of government
to a Mayor-Council Plan E under the Charter. The Board of Health of
the Township of Mine Hill is hereby abolished. All legislative functions
formerly conducted by the Board of Health, including adoption of ordinances,
resolutions and codes relating to health and welfare, shall henceforth
be vested in the Council.
B.Â
Generally. The Department of Health shall have and exercise and discharge
all health and welfare functions, powers and duties (except legislative
functions relating thereto) as may be provided or assigned to the
Township by general law, the Charter, this Code or other ordinances
of the Township.
A.Â
Establishment. There is hereby established a Division of Health within
the Department of Health, the head of which shall be the duly licensed
Health Officer serving the Township, who shall be appointed by the
Mayor with the advice and consent of the Council to serve at the pleasure
of the Mayor, but for a term not longer than the term of the Mayor
appointing him. The compensation to be received by the Health Officer
shall be fixed annually by ordinance.
B.Â
Functions of the Division of Health. The Division of Health under
the direction of the Health Officer shall:
(1)Â
Plan and administer a comprehensive public health program, including,
without limitation thereto, environmental sanitation, communicable
disease control, public health nursing service, health education and
the operation of public health clinics.
(2)Â
Administer and enforce the local health and sanitation ordinances
and all state health codes and laws applicable to the Township.
(3)Â
Perform all functions and duties conferred by general law, the Charter
or ordinances upon any municipal health officer, health bureau, health
department or health agency.
(4)Â
Carry out all the health duties and functions required of the Township
pursuant to the Local Health Services Act (N.J.S.A. 26:3A2-1 et seq.).
(5)Â
Provide for animal control within the Township.
(6)Â
Supervise and provide all vital statistics services and functions
required by law to be furnished by the Township.
(7)Â
Provide for garbage and solid waste collection and disposal by contracting
for such services or otherwise prepare specifications and supervise
the performance of all garbage and solid waste collection services
provided by the Township.
C.Â
Animal Control Officer. There is hereby created the position of Animal
Control Officer, who shall be appointed by the Director of Health
for a one-year term, commencing January 1 of each year. The Animal
Control Officer shall receive such compensation as shall be fixed
annually by ordinance. The Animal Control Officer shall enforce all
ordinances and other laws relating to dogs, cats and other animals
within the Township of Mine Hill.
D.Â
Contracted health services. The Mayor, with the approval of the Council,
in accordance with the requirements of the Uniform Shared Services
and Consolidation Act (N.J.S.A. 40A:65-1 et seq.), may, by contractual
arrangements with other municipalities, provide the health services
and health officials which the Township is required to furnish and
employ pursuant to the Local Health Services Act (N.J.S.A. 26:3A2-1
et seq.) and other controlling laws, including the services of a health
officer, sanitarian and public health nurses.[1], [2]

of the 1986 Revised General Ordinances, which immediately followed
this section, was repealed 12-16-2004 by Ord. No. 13-04. Ordinance
No. 13-04 also transferred all responsibilities of the Local Assistance
Board to the Morris County Board of Social Services and provided that
the administration of the WFNJ/GA program shall be administered by
the Morris County Board of Social Services.
