Unless superseded or displaced by the particular provisions
of this article, and New Jersey state statute, N.J.S.A. 40A:11-1 et
seq. and the provisions of the New Jersey Local Public Contracts Law
as contained in N.J.A.C. 5:34-1.1 et seq., the principles of law and
equity, including the Uniform Commercial Code, the law relative to
capacity of contract, principal and agent, fraud, misrepresentation,
duress, coercion, mistake, or bankruptcy shall supplement its provisions.
The Township Council hereby adopts a new chapter to the Code
of the Township of Mine Hill entitled "Procurement" and promulgating
a Purchasing Procedures Manual for use and implementation by Township
departments, agencies, boards and commissions.
This article shall apply to every expenditure of public monies
by the Township of Mine Hill under any contract, or like business
agreement, excepting only that this article shall not apply to contracts,
grants or like business agreements between the federal, state and
local jurisdiction, except as specifically otherwise provided in this
article.
The Purchasing Procedures Manual is available for public inspection
in the offices of the Township Clerk during normal business hours.
Failure to strictly adhere to the provisions of the Purchasing
Procedures Manual will result in the imposition of discipline ranging
from a reprimand to and including dismissal and/or removal from office.
The Township Council will serve as final arbiter in enforcing and
disciplining violators of this article.
