[HISTORY: Adopted by the Township Council of the Township of Mine Hill by Ord. No. 227A-79 (Ch. X, Sec. 10-1, of the 1986 Revised General Ordinances). Amendments noted where applicable.]
The purpose of this chapter is to combine and organize as one department, to be known as the "Department of Public Works," the responsibilities and operations previously conducted by the Road and Water Departments. In addition, it is the purpose of this chapter to place the responsibility for maintenance of all buildings and grounds for which the Township is responsible in this Department of Public Works, and to also confer upon this Department of Public Works the responsibility for operating and maintaining any additional utilities and services, such as a sanitary sewer system, which the Township may elect to provide to its residents.
There is hereby created a Department of Public Works. The Department of Public Works shall have the following functions, powers and responsibilities:
A. 
Roads. Maintain, clean, improve and repair all roads, sidewalks, curbs and other roadway appurtenances in the Township for which the Township is responsible, including, but not limited to, brush cutting and mowing, grading, cleaning, repairing and improving of storm drains and ditches, snowplowing, sanding and salting of roads to keep same free of snow and ice, and trimming and removal of trees, where necessary, and installation, maintenance and repair of traffic and roadway signs.
B. 
Building and grounds. Maintain, repair and care for all public buildings, grounds and facilities within the Township which the Township owns or has the right to use and occupy for public purposes, or for which the Township is responsible, including, but not limited to, the Municipal Building, municipal beach and related facilities, school grounds, parking areas and walkways, public playgrounds, ball fields and other public recreational facilities, first aid facilities and the parking areas, grounds and outside facilities of the Township's firehouses and companies.
C. 
Water service and facilities. Install, maintain, repair, operate, administer and care for the Township's water system and lines and appurtenances, including, but not limited to, the installation, repair and replacement of water meters, the reading of water meters, location and repair of water leaks and frozen pipes, provide and maintain such reports and records as may be required in providing water service to Township residents and conduct such tests as may be necessary to properly operate and maintain the Township's water system.
D. 
Vehicles and equipment. Maintain, service, store and repair (or arrange for repair) all vehicles and equipment owned and/or used by the Township in carrying out the functions and responsibilities of the Department of Public Works, including the maintenance and repair of vehicles assigned to and used by the Department of Public Safety, and the maintenance and repair of all storage areas and facilities maintained by the Township.[1]

There shall be organized within the Department of Public Works a Division of Water, the head of which shall be the Director of Water. The Division of Water shall be responsible for maintaining, operating, administering and caring for the Township's water system and facilities and performing all other duties relating thereto as more particularly described above in § 74-2C. The Division of Water shall perform all of the functions and provide the various services conferred upon and assigned to the Township of Mine Hill Water Department by the ordinance entitled "An Ordinance Establishing Rules, Regulations, Costs and Fees of the Water System and Water Department of the Township of Mine Hill."[1] The Division of Water shall operate as a public water utility in the same manner as the Water Department previously operated as a water utility, with separate appropriations, in operating the Township's water system and facilities.
A. 
Director of Water. The Director of Water shall supervise and direct the operations of the Division of Water. The person appointed to the position of Public Works Manager may be the Director of Water. The Township Council shall annually fix the salary to be paid to the Director of Water for duties performed in supervising and directing the operations of the Division of Water, which salary shall be separate and apart from the salary fixed and paid annually to the Public Works Manager for supervising all the operations and functions of the Department of Public Works and carrying out the various other duties assigned herein to the Public Works Manager.

B. 
Independent water utility operation.
(1) 
All operations, functions, duties, expenses, appropriations, fees, income and revenues of the Division of Water shall for budget and all other purposes be accounted for and recorded separately upon the records of the Township and shall not be combined with appropriations, expenses and income applicable to the other operations and functions of the Department of Public Works. To the extent it is feasible to do so, each annual budget and salary ordinance of the Township shall fix and appropriate a separate salary or wage for the Foreman of the Department of Public Works, and any other employee of the Department of Public Works who performs duties and work for the Division of Water, providing compensation for such duties and work performed for the Division of Water, separate and apart from any other compensation which may be paid any such employee for other duties and work performed for the Department of Public Works. In any event, detailed time records shall be kept of each employee of the Department of Public Works who performs work for the Division of Water showing the amount of time each such employee devotes daily, weekly and annually to the Division of Water, as compared to time spent by each such employee in performing other work and duties for the Department of Public Works.
(2) 
In all respects, the Division of Water shall operate the Township's water system and facilities as a separate and independent water utility in accordance with the terms, conditions and requirements of this section establishing and regulating the Township's water system as a utility.

There is hereby established and created the position and office of Public Works Manager. The Public Works Manager shall supervise and direct the operations of the Department of Public Works subject to the supervision of the Director of the Department of Public Works. The general powers and duties of the Public Works Manager shall include, but not be limited to, the following:
A. 
General supervision and direction of the work for the Department of Public Works and all employees of such Department.
B. 
On-site and on-job supervision of all public works projects and operations, except for such supervisory duties are delegated by the Public Works Manager to the Foreman or other employee of the Department of Public Works.
C. 
Supervise the preparation and keeping of all records pertaining to public works projects and operations, including, but not limited to, employee records and payroll, inventory control records, preparation of budget requests for the Department and monitoring expenditures against budget allowances.
D. 
Prepare or supervise the preparation of any sign and approve all purchase orders and vouchers to secure supplies and equipment required by the Department of Public Works; prepare bid specifications and coordinate with the Township Clerk public bidding when required by law in connection with the acquisition of supplies and equipment; supervise and arrange for cooperative purchasing of supplies and equipment with other municipalities.
E. 
Perform the functions of procurement officer for the Township in connection with acquisition of surplus equipment and supplies from governmental sources.
F. 
Prepare monthly reports of the Department's activities for the Township Council and meet with the Township Council or its designated member(s) to review, discuss and report upon Department activities and Department employees.
G. 
Interview all prospective employees of the Department of Public Works, evaluate not less than once each year the performance of all employees of the Department of Public Works, and recommend to the Township Council those persons and employees the Public Works Manager wishes to be hired, discharged or advanced.
H. 
Coordinate with the Township Engineer all construction projects by outside contractors involving Department of Public Works facilities; attend all construction meetings relating to the work of outside contracts; assist the Township Engineer in making such inspections as may be necessary in connection with construction projects being performed by outside contractors.
I. 
Secure the assistance and advice of the Township Engineer whenever such advice is deemed necessary or desirable by the Public Works Manager in supervising and administering the work of the Department.
J. 
In addition to the duties specified in Subsections A through I immediately above, the Public Works Manager shall operate any and all equipment and vehicles under the jurisdiction of the Department of Public Works and shall also, in addition to carrying out his supervisory duties at job and project sites, perform such other duties and work (including assisting the other employees of the Department of the performance of their assigned tasks) as the Public Works Manager deems necessary to assure that the duties, functions and responsibilities of the Department of Public Works are performed in a timely and adequate fashion.

There is hereby created the position of Foreman of the Department of Public Works. The duties and responsibilities of the Foreman shall include the following:
A. 
As directed and delegated by the Public Works Manager, to supervise and direct at job and project sites the work of the other employees of the Department of Public Works.
B. 
In the event of the absence of the Public Works Manager due to illness, vacation, or otherwise, to perform such additional supervisory duties and functions as may be assigned.
C. 
The operation of all equipment and vehicles under the jurisdiction and control of the Department of Public Works in order to carry out the various public works projects and specific jobs and tasks for which the Department of Public Works is responsible.
D. 
The performance of such other duties, assignments and work, including, but not limited to, training and assisting other employees of the Department on the performance of manual labor and the various other tasks as are required of such other employees, in order to carry out the functions and responsibilities of the Department of Public Works in an adequate, efficient and timely fashion.
E. 
The performance of such other duties and tasks as may from time to time be requested of the Foreman by the Public Works Manager.
There shall be such other positions in the Department of Public Works as may from time to time be established by the Township Council by providing a salary or rate of pay for same as part of the annual Salary Ordinance, or any amendment thereto.
