The intent of this chapter is to preserve health, safety and
welfare of the residents of the Township by regulating the location
and use of dumpsters throughout the Township.
As used in this chapter, the following words shall have the
meanings indicated:
Any container or receptacle used for the disposal of any
material having a capacity of not less than three cubic yards.
Three or more dwelling units located on the same property
under common ownership.
A dumpster/refuse container that is not used for the normal
disposal of waste from the day-to-day operation of any multifamily,
commercial or industrial buildings and specifically includes those
used for the disposal of construction debris, demolition debris and
similar materials.
A.
No dumpster/refuse container shall be placed in any location that
damages Township or other publicly owned property. All precautions
must be used in placing dumpsters/refuse containers to protect public
property, including the placement of boards under those portions of
the dumpster/refuse container that contact the ground.
B.
Single-family residential zones. No dumpster/refuse container shall
be located within 10 feet of an abutting dwelling, unless the occupant
of the abutting dwelling agrees to such and signs an authorization
form which shall be submitted with the permit application for the
dumpster/refuse container. No dumpster/refuse container shall be located
on a public street or alley unless a permit is obtained from the Zoning
Officer. No dumpster/refuse container shall be placed so that it blocks
any public sidewalk.
C.
Multifamily, commercial and industrial zones. No temporary dumpster/refuse
container shall be located within 10 feet of an abutting residential
property or on a public street or alley unless a permit is obtained
from the Zoning Officer.
D.
If permitted and the dumpster/refuse container is placed on a public
street or alley, the dumpster/refuse container shall be directly in
front of or on the side of the property address utilizing the dumpster/refuse
container. Additionally, a dumpster/refuse container placed in the
street shall:
(1)
Not be more than 18 inches from the curb;
(2)
Not obstruct driveways of abutting properties;
(3)
Not obstruct traffic;
(4)
Be protected at both ends by a barricade, which, after sunset, shall
have a flashing yellow light attached to it;
(5)
Have a reflector or reflective area of not less than 36 square inches
at each end; and
(6)
Be located in accordance with state law.
E.
A dumpster/refuse container shall not be placed on the public street
if on-street parking for vehicles is not allowed at that location.
A.
Single-family residential zones. A dumpster/refuse container and
any replacement dumpster/refuse container shall not be placed for
a total of more than 14 days in any six-month period if placed on
the street and not more than 30 days in any six-month period if placed
elsewhere.
B.
Multifamily and commercial. A temporary dumpster/refuse container
and any replacement temporary dumpster/refuse container placed under
this chapter and not in a public street may remain on the site as
long as required, but not to exceed a total of six months. A temporary
dumpster/refuse container or any replacement temporary dumpster/refuse
container placed upon a public street may be placed for not more than
a total of 14 days in any six-month period.
C.
Industrial. A temporary dumpster/refuse container or any replacement
temporary dumpster/refuse container placed under this chapter may
remain on the site as long as needed, but not to exceed a total of
18 months.
D.
Extension of time. Active and ongoing construction or projects may
obtain from the Township Zoning Officer an extension of the time during
which a dumpster/refuse container may remain on a site. Any extension
shall be granted in the sole discretion of the Zoning Officer.
The following requirements shall be maintained while any dumpster/refuse
container is on or at the site:
A.
The area around the dumpster/refuse container shall be kept free
of debris and litter;
B.
Any dumpster/refuse container into which animal or vegetable waste
or material has been dumped or deposited shall be removed or emptied
within 24 hours;
C.
Any dumpster/refuse container producing or causing noxious, foul
or offensive odors shall be immediately removed or cleaned to eliminate
the odor; and
D.
A full dumpster/refuse container shall be removed from the property
within two days.
A dumpster/refuse container shall only be used to contain and
remove debris and material generated at the location where the dumpster/refuse
container is placed.
The name and telephone number of the owner of the dumpster/refuse
container and/or the company that is responsible for the dumpster/refuse
container shall be displayed in a weatherproof manner on the dumpster/refuse
container.
A zoning permit shall be required for a dumpster/refuse container. The permit shall be obtained from the Zoning Officer after paying the required fee, which shall be as set forth in Chapter 235, Fees. The permit shall be displayed in a weatherproof holder on the dumpster/refuse container.
Any dumpster/refuse container not in compliance with this chapter
is hereby declared to be a public nuisance and may be abated by the
Township at the owner's or responsible person's expense. Abatement
shall, at the Township's option, include the removal and/or the emptying
of the dumpster/refuse container.
A.
Any person who violates or neglects to comply with any provision of this chapter or the Code established herein or notice issued pursuant thereto shall, upon conviction thereof, be liable to the general penalty as stated in § 1-3 of this Code.
B.
In addition to any other penalty that may be imposed, a person found
guilty of a violation of this chapter shall be ordered to abate the
problem and pay any and all costs incurred by the Township, if the
Township abated the problem.
