Any person, persons or organization desiring to use the City Park for commercial purposes shall make due application therefor with the Mayor or Board of Aldermen stating the date and time they so intend to have the use of said City Park, and every person, persons or organization so using the City Park for commercial purposes, shall arrange to pay a rental fee in an amount determined from time to time by the Board of Aldermen.

There is hereby created the office of Superintendent for the City Park of Hermann, said office to be filled by appointment made by the Mayor by and with the consent of the Board of Aldermen as provided for in Section 110.020.

Said Park Superintendent shall at all times keep the grass properly cut on that part of the City Park herein described, to-wit: West to Washington Street including the terrace, south to the road-way leading into said park, east to the fence between said park and the ball park and north to the property line of said park. Said Park Superintendent shall also at all times keep said City Park as above described clean of rubbish, paper, bottles, leaves, brush, clean away all broken trees or parts thereof and properly attend to all flowers in the park and the ball park and north to the property line of said park in a clean and sanitary condition. He shall see to it that no dogs are permitted to run at large in said City Park.

There is hereby established a Park Board, the membership of which shall consist of nine (9) members appointed by the Mayor with the approval of the Board of Aldermen. The members shall be chosen at large with reference to their fitness for such office. No member of the city government shall be a member of the Board.

The directors shall hold office, one-third (1/3) for one (1) year, one-third (1/3) for two (2) years and one-third (1/3) for three (3) years from the first (1st) of June following their appointment, and at their first (1st) regular meeting shall cast lots for their respective terms; and annually thereafter the Mayor shall, before the first (1st) of June of each year, appoint as before three (3) directors, who shall hold office for three (3) years and until their successors are appointed. The Mayor may, by and with the consent of the Board of Aldermen, remove any director for misconduct or neglect of duty.

Vacancies in the Board of Directors, occasioned by removal, resignation or otherwise, shall be reported to the Board of Aldermen and be filled in like manner as original appointments, and no directors shall receive compensation as such.

Said directors shall immediately after their appointment meet and organize by the election of one (1) of their number president, and by election of such other officers as they may deem necessary. They shall make and adopt such bylaws, rules and regulations for their guidance and for the government of the parks as may be expedient, not inconsistent with Sections 90.500 to 90.570, RSMo., and ordinances of the City of Hermann. They shall have the exclusive control of the expenditures of all money collected to the credit of the park fund and the supervision, improvement, care and custody of said park. All moneys received for such parks shall be deposited in the treasury of said City to the credit of the park fund and shall be kept separate and apart from the other moneys of the City of Hermann and drawn upon by the proper officers of said City upon the properly authenticated vouchers of the Park Board. Said board shall have power to purchase or otherwise secure ground to be used for such parks, shall have power to appoint a suitable person to take care of said parks and necessary assistants for said person and fix their compensation, and shall have power to remove such appointees; and shall in general carry out the spirit and intent of Sections 90.500 to 90.570 RSMo., in establishing and maintaining public parks.

The Board of Directors have the authority to accept any donation of money, personal property or real estate for the benefit of the park to be held and controlled according to the terms of the deed, gift, devise or bequest of such property.

Except as provided in Subsection (A) hereof, there are hereby levied the following user fees for the designated facilities and services in the Hermann City parks:
1. 
Camping fees

Swimming pool. Swimming pool hours, fees for pool use, season pass charges, classes to be offered and the times and charges for such classes and pool facility rental fees shall be as recommended by the City Administrator and approved by the Board of Aldermen, by motion.

All pavilion reservations must be made a minimum of forty-eight (48) hours in advance of intended use. A pavilion may be reserved for use for a maximum period beginning at 7:00 A.M. and ending at the earlier of:
a.
Fifteen (15) minutes before the applicable park curfew, or
b.
7:00 A.M. of the following day for a pavilion not located within a part of the City park system subject to a curfew.
The time of commencement of the reservation shall be designated by the applicant when reserving the pavilion.
10.

One (1) Day Rental Fee: The one (1) day rental fee is one hundred fifty dollars ($150.00).
b. 
Security/Cleaning Deposit: A five hundred dollars ($500.00) security/cleaning deposit is required.
c. 
Rental Fee For The Brush And Palette Club. The rental fee for the Brush and Palette Club for any length of time shall be one dollar ($1.00).
d. 
Rental Agreement. Rental shall comply with such other terms and conditions as may be provided in the rental agreement to be provided by the City Clerk.

Other park facilities.

All security and cleaning deposits required for City park facilities must be posted in cash or by cashier's check at the time of making the request for usage or the reservation; and such deposits will be refunded if the facility is returned in the condition in which it was received.
14. 
Sesquicentennial Park.

a. 
The rental fee per event within any one (1) day is fifty dollars ($50.00).
B. 
The user fees designated for facilities described in paragraphs 2, 6, 7, 8, 9 and 10 of Subsection (A) hereof shall be adjusted to $0.00 for any event conducted with in such facility by a not-for-profit organization with its principal office located within the City of Hermann and which holds a current exemption from payment of Missouri income and sales and use taxes, provided that such organization certify, in writing, at the time of applying for the reservation that the intended event is:

1. 
For the primary benefit of its members;
2. 
Of a type for which it was organized and for which the organization was granted the tax exemption; and
3. 
Not for the primary purpose of raising funds by the charging of an admission fee or by the sale of merchandise or services.

It shall be unlawful for any person to use or attempt to use any of the above designated facilities or services without first paying to the appropriate officer or agent the required fee as provided by this Chapter.

Violation of any provision of this Chapter shall be a misdemeanor.
