[1997 Code § 304-15]
No person shall erect or allow any canopy which protrudes over
the public right-of-way without having received a license from the
City.

The license fee for a canopy complying with the provisions of
this Article shall be $50 for each building which contains an approved
canopy or canopies.

Any canopy licensed pursuant to this Article shall meet the
following requirements:
A. The bottom of the canopy, or any part thereof, shall be at least
eight feet above the sidewalk.
B. The canopy shall not protrude into the City's right-of-way farther
than three feet and shall not extend into the cartway of any street.
C. The structure and construction of the canopy shall comply with the
Uniform Construction Code and the BOCA Code, as they may be amended
from time to time.
D. The canopy and any signage on the canopy shall comply with all applicable
City ordinances.
E. The canopy shall be maintained in good condition and repair. Any
canopy which is not maintained shall, after notice from the City Construction
Code Office and an opportunity to correct any deficiency, be required
to be removed.
F. Canopies shall only be permitted pursuant to this Article in the
commercial districts of the City.

Any applications for licenses pursuant to this Article shall
be made to the Construction Code Office and shall be reviewed by the
Zoning Officer and the Construction Code Official. The application
shall contain whatever information is determined to be necessary by
the Construction Code Office, including a survey of the property involved.
