As used in this chapter, the following terms shall have the meanings indicated:
BODY-BOARD
A device or manufacture of a rigid, buoyant material of approximately three feet in length, designed or suitable to be held or laid upon for the purpose of riding ocean waves.

SURF
The area of the ocean adjoining the shoreline in the public park of the City of Atlantic City.
SURFBOARD
A device or manufacture of a rigid, buoyant material of approximately six feet to 10 feet in length, designed or suitable either to be stood or laid upon for the purpose of riding ocean waves.

SURF-RIDING
Standing or lying on a surfboard for the purpose of riding ocean waves; or lying on a body-board for the purpose of riding ocean waves.

A. 
Between Memorial Day and the last Sunday in September:
(1) 
Surf-riding with surfboards and stand-up paddle boarding shall be permitted only in the surf at New Hampshire Avenue, Delaware Avenue, between Raleigh Avenue and Annapolis Avenue and the area bounded by Newton and Jackson Avenues, and beginning at Steel Pier South to a point 100 feet south of the southern border of Pennsylvania Avenue currently marked by the existing outfall pipe.

(2) 
Surf-riding with body-boards shall be permitted on all beaches subject to § 227-7 of this chapter.
B. 
While surf-riding, all persons must use a tether or leash to prevent the surfboard or body-board from leaving their control and injuring others.
The above-mentioned areas set forth in § 227-3 of this chapter shall be designated and posted with signs near the high-water line, setting forth that surfing is permitted and that surf bathing is dangerous and is done at the risk of the bather. Lifeguards shall also announce at regular intervals with loudspeakers that the use of the beach in the areas set forth in § 227-3 is primarily for surfing and that bathers are using the surf at their own risk.

Any person violating any of the provisions of this chapter shall, upon conviction thereof before the Municipal Court Judge of the City of Atlantic City, be sentenced to pay a fine not exceeding $2,000 or be imprisoned for not more than 90 days in the county jail, or both, in the discretion of said Municipal Court Judge.

A. 
The Chief of lifeguards or designated officers may limit or prohibit surf-riding at times they determine that prevailing weather or other conditions may tend to make surf-riding unsafe to surfers or other bathers.
B. 
The Chief of lifeguards may regulate types and designs of surfboards and body-boards allowed to be used for surf-riding and may prohibit the use of equipment which he or she deems unsafe.
