A. In accordance
with Section 79.230, RSMo., the Mayor of the City of Weston, Missouri,
with the consent and approval of the majority of the members of the
Board of Aldermen, shall have the power to appoint a Chief of Police
and any such other officers deemed necessary for the best interests
of the City and authorized by ordinance may hereby establish a Police
Department in the City of Weston, Missouri, for the purpose of the
active and vigilant preservation of good order within said City.
B. The Board
of Aldermen shall provide the necessary funds and equipment for the
maintenance and operation of said Police Department.

No person shall be appointed to the office of Chief of Police
who is not twenty-one (21) years of age, nor who at the time of his/her
appointment is in arrears for any unpaid City taxes or forfeiture
or defalcation in office, nor who has not been a resident of this
State for at least one (1) year prior to his/her appointment. The
office of the Chief of Police is considered a full-time job. He/she
shall have no other employment without the consent of the Mayor and
Board of Aldermen. It is the intention of the Board of Aldermen that
the Chief of Police be able to promptly respond to any emergency.

No person shall be appointed to the position of Police Officer,
full-time, part-time or reserve, who is not a certified Peace Officer
as required by Chapter 590, RSMo., nor who at the time of his/her
appointment is in arrears for any unpaid City taxes or forfeiture
or defalcation in office, nor who is not a bona fide resident of the
State of Missouri at the time of his/her appointment.

A. Any Police
Officer of the City of Weston who completed the basic Police training
program as established by Chapter 590, RSMo., have the authority to
respond to an emergency situation outside the boundaries of the City,
provided however, no Police Officer shall be required by reason of
this Section to leave the jurisdiction to respond to an emergency
situation, but said Police Officer shall use his/her said discretion
and judgment as to leaving the City to respond to an emergency situation.
B. It shall
be the policy of the City that Police Officers shall not leave the
City inhabitants with inadequate Police protection or be absent for
extended periods of time, but that the response shall be in aid of
and to assist the authorities of the County or the municipality in
which the emergency situation is located. No Police Officer of the
City shall be authorized to make an arrest by reason of this authorization
to respond, nor shall they be authorized to use their weapon except
to protect themselves or to effectuate an arrest for a serious felony
endangering the lives or threatening serious property damage to one
(1) or more persons in the area.
C. The authority
contained herein shall permit the response by one (1) or more City
Police Officers in an area not to exceed ten (10) miles from the City
limits of the City of Weston, Missouri.
D. Every
response to an emergency situation outside of the City shall be reported
in writing within twenty-four (24) hours of such response, by the
Chief of Police to the Mayor and to the Board of Aldermen Police liaison,
with an explanation of the reason for the response. This written explanation
shall state who requested or directed the officers to leave the City,
the time of the departure from the City, the time the officer or officers
returned to the City, the name of the City Official who was notified
of the emergency situation, who was taken care of and the name of
the agency the emergency situation was turned over to and any other
pertinent information regarding the response.
