The Village of Elm Grove has caused to be installed certain infrastructure facilities in order to facilitate water service to properties within the Village. Water service will be provided by the City of Brookfield. In order to provide funding for and to ensure a fair allocation of costs to properties benefiting from these facilities, a water connection fee may be imposed on certain properties in the Village.
A. 
The Village may establish water service subareas in order to plan for water infrastructure improvements and to provide for recovery of capital costs, cost of money and administrative costs.
B. 
A water service subarea shall be a geographically defined area of the Village that may require certain water system improvements. Each water service subarea shall be defined by a map that shows the area boundaries and properties contained within the subarea. Each water service subarea map shall be approved by the Village Board and filed with the Village Clerk or designee and incorporated by reference in this article as if fully set forth.
A. 
The Village may establish separate water connection fees for each designated water service subarea.
B. 
All properties within a designed water service subarea requesting to be connected shall be subject to imposition of the water connection fees as outlined in this section. All fees shall become due and payable at such time as a water service connection is requested from the City of Brookfield. Payment shall be made to the Village of Elm Grove within 30 days of connection. Any fees not paid in 30 days shall be placed on the property tax bill as a special charge under § 66.0627, Wis. Stats.
C. 
The water connection fee is separate and apart from any fees and charges that may be imposed by the City of Brookfield as a condition for service, and all such fees and charges shall be the responsibility of the individual property owners.
D. 
Any delinquent water usage payments shall be placed on the tax bill, with interest of 1% per month, per § 66.0627, Wis. Stats.
A. 
Fees shall be based upon estimated annual water usage for each property requesting water service. Each property shall be assigned a residential equivalent connection (REC) factor. A residential equivalent connection shall be defined as the estimated annual water usage volume for a typical residential property using the methodology identified in § 232-15 and used for sewer billing purposes.
B. 
For purposes of computing fees due, a REC factor shall be assigned to each property at the time of request for water service, based upon the volumes used in the most recent local sewer user charge billing converted to an annual basis and divided by the defined volume for one REC. All REC factors shall be rounded to the nearest 0.25 REC, and all properties shall be assigned a minimum of 0.5 REC.
C. 
To provide for a fair allocation of costs between residential and commercial (nonresidential) properties and to reflect the fact that the cost of providing water service to commercial areas is higher than that for residential areas, the per-REC fees for commercial properties shall be adjusted upward by a factor of 1.111 of that for residential properties.
D. 
The water connection fees imposed shall include a portion of the original connection expense which has been calculated to be $97.12 per REC with the remainder of the fee to be equal to the assigned REC factor for each property multiplied by the fee amount per REC as follows:

Properties in water service subarea 1 (initial service area):
(a) 
Residential properties (fee per dwelling unit):

Two-bedroom multifamily units (0.75 REC): $3,011.75.
[3] 
Three or more bedroom multifamily units (1 REC): $4,015.66.
[4] 
Single-family home (1 REC): $4,015.66.
(b) 
Commercial properties (per REC): $4,461.41.
(c) 
Interest rate compounded annually: 3%.
(2) 
Properties in Water Service Subarea 2 (760 feet west of Elm Grove Road on Bluemound Road, including Carriage Hills Condominiums and The Park Condominiums).

(a) 
Three-or-more-bedroom multifamily units (1 REC): $2,605.26.
(b) 
The Park Condominiums (44 REC): $114,631.44.
(c) 
Carriage Hills Condominiums (32 REC): $83,368.32.
(d) 
The Park shall pay the total project costs of $197,999.76 at time of connection. The Village shall refund to The Park Condominiums $83,368.32, without interest, within 45 days of receipt of connection fees from Carriage Hills.
(e) 
Interest rate compounded annually: 3%.
E. 
The fee amounts shall be increased on an annual basis as established by this schedule, commencing January 1, 2014, at a rate established based on the cost of monies. Water connection fees shall be updated on an annual basis and kept on file in the office of the Village Clerk.
A. 
Any person found violating the provisions of this article shall be provided written notice stating the nature of the violation and providing a reasonable time, not to exceed 30 days, for the correction of the violations.
B. 
Any person who shall continue any violation beyond the aforesaid time limit provided in a written notice of violation shall be subject to a penalty as provided in § 1-16 of this Code, except that the forfeiture shall not be less than $100.
