No vehicle or combination of vehicles shall be moved or operated on any highway, street or alley in the City having a greater weight than that described under Section 304.180, RSMo., provided that the Governing Body and State Highways and Transportation Commission or their legal agents for their respective jurisdictions, whenever by thawing or frost, rains, or soft conditions due to construction, reconstruction and maintenance, adverse critical weather conditions, or other causes detrimental to the surface or physical condition of such highways, streets and alleys in the City are hereby authorized to limit the weights described under this Section to such an amount and in such manner as will preserve their economical use by the general public.

When posted or marked it shall be unlawful to transport any gross load in excess of the posted notice, and, in addition to conviction and punishment, the registered owner of any such vehicle shall be held liable in any court of competent jurisdiction for destructive damage to the surface and physical conditions pertaining.

When signs are erected giving notice thereof, no person shall operate a commercial vehicle with a gross weight over five (5) tons upon a City street or alleyway or parts thereof, except that such vehicles may make local deliveries upon such streets. Construction vehicles working in areas serviced only by such streets shall enter and leave the area of such streets by the shortest and most direct routes to other streets servicing such limited load streets. Restrictions set forth herein apply to the following streets and appropriate signs shall be posted:
Barr Road, from R.D. Mize Road to US Highway 40
Broadway Street, Valley Drive to Main Street
Canon Street, Young Street to Main Street
EE Kirby Road, US Highway 40 to Eagles Parkway
Golfview Drive, R.D. Mize Road west to Tyer Road
Harris Street, Young Street to Main Street
Nelson Drive, Buckner Tarsney Road to Cross Creek Drive
Tyer Road, R.D. Mize Road north to I-70
Tyer Road from Jefferson Street to the north City limits of the City of Grain Valley
Valley Woods Court, R.D. Mize to Barr Road
Walnut Street, E.E. Kirby Road to Main Street
West Front Street, E.E. Kirby Road to Main Street
West Yennie Street, E.E. Kirby Road to Main Street
Woodbury Drive, Duncan Road to Buckner Tarsney Road (BB Highway)

No vehicle or combination of vehicles having a greater width, height or length than that prescribed under Section 304.170, RSMo., shall be moved or operated on any highway, street or alley in the City having a greater weight than that prescribed under Section 304.180, RSMo., as amended, which Sections are incorporated by reference herein as though fully set forth.

No truck shall be operated on any street with a gross weight in excess of the weight for which such truck has been duly licensed by the State.

Upon the request of any Police Officer, the operator of any vehicle shall permit such vehicle with its load, if any, to be weighed on the spot by the use of loadometers or other weighing device; or if such Police Officer shall so request, shall forthwith convey such vehicle and load, if any, to the nearest City scale or public scale to be designated by such Police Officer, for the purpose of establishing the weight and load of such vehicle; and if the weight thus established is in excess of the maximum weights herein limited, such excess load shall be unloaded before such vehicle may proceed.

A. 
Notwithstanding the provisions of this Chapter, the Chief of Police or Public Works Superintendent may, at his/her discretion, issue a special permit for the carrying of single, individual loads in excess of the weights herein limited. Such permit shall prescribe the route and time of movement and traffic safety requirements as approved by such Chief of Police or Street Commissioner, as well as precautions to be taken in carrying of such load; and the beneficiary thereof shall be liable to the City in civil suit for the cost of repair to public streets or other public places injured or damaged by anything done under such permit or in violation thereof. Such Chief of Police or Public Works Superintendent may, at his/her discretion, require the applicant for such permit to furnish a bond to the City, conditioned so as to secure to the City the payment of any such costs of repair. Such permit shall be for no more than one (1) load or train of loads, and shall be carried in the vehicle and upon request be shown to any Police Officer of the City.
B. 
The Chief of Police or Public Works Superintendent may, at his/her discretion, issue a special permit for loads that exceed the maximum for width, length, or height. This permit shall prescribe the route and time of movement, as well as any traffic safety precautions to be taken in moving such load. The beneficiary thereof shall be liable to the City in civil suit for any damage to public streets or other public places resulting from movements made under this permit. Such special permit must be carried in the vehicle and upon request be shown to any Police Officer. A violation of the terms of permits issued by the Chief of Police or Public Works Superintendent, as provided in this Section, shall be deemed and considered to be violation of this Chapter and punishable as provided herein.

Any person violating any provision of this Chapter shall be deemed guilty of an ordinance violation, and upon conviction thereof, shall be subject to punishment as provided in Section 100.110 of this Code.
