[HISTORY: Adopted by the Borough Council of the Borough of Lewistown 9-14-1981 by Ord. No. 81-6 (Ch. 1, Part 5E, of the 1986 Code). Amendments noted where applicable.]
Pursuant to the authority of Act 108 of 1979 (which amended § 402.1 of the Pennsylvania Unemployment Compensation Law[1]) and pursuant to the Borough Code,[2] there is hereby created and established for the Borough of Lewistown an educational service agency which shall be known as the "Educational Service Bureau of the Borough of Lewistown." The exclusive function of the Educational Service Bureau and the purpose for which it has been established shall be to appoint, employ and supervise such school crossing guards (referred to as "special school police" in the Borough Code) as may be necessary or desirable in providing school crossing guard services on days when school is in session to schools which are within the Borough of Lewistown and under the administrative jurisdiction or operational control of the Mifflin County School District.

In order to carry out the function of the Educational Service Bureau, there is hereby established and created an autonomous governing board which shall be known as the "Board of the Educational Service Bureau." The Board of the Educational Service Bureau shall be comprised of three members: the President of the Borough Council, the Chairman of the Finance and Budget Committee and the Borough Manager. The members of the Board shall serve without compensation.
In order that the Educational Service Bureau may perform the function for which it is established, the Borough Council hereby delegates to the Board of the Educational Service Bureau the authority and powers granted the Borough Council under the Borough Code.[1] In addition to but not in limitation of the powers set forth in the Borough Code, the Board of the Educational Service Bureau shall have the following powers, and it shall be the Board's duty to:
A. 
Prepare and submit an annual budget to the Borough Council for Councilmanic review and approval and adopt that budget as approved or modified by the Borough Council.
B. 
Determine and administer such policies and procedures with respect to the Bureau's income, expenses, finances, budget and organization as the Board deems proper.
C. 
Within and subject to the budget adopted by the Board, fix the compensation and benefits to be paid to the Bureau's school crossing guards.
D. 
Establish and oversee personnel policies, work procedures and work programs for the Bureau's school crossing guards; make appropriate rules and regulations governing the work and conduct of the Bureau's school crossing guards; establish work schedules and work assignments for the Bureau's school crossing guards; and transfer, assign and reassign the Bureau's school crossing guards.
E. 
When necessary, discharge, suspend or otherwise discipline the Bureau's school crossing guards.

For the purpose of day-to-day administration, management and supervisory control, and in order to afford the Board of the Educational Service Bureau with day-to-day office personnel, supervisory personnel and resource personnel, the day-to-day administration and management of the Educational Service Bureau shall be under the control of the Administration, Management and Financial Department of the Borough of Lewistown, and the day-to-day direction and supervision of the work assigned to and the duties to be performed by the Bureau's school crossing guards shall be under the control of the Chief of Police and the Mayor.
