For the purposes of this Chapter, the following terms shall be deemed to have the meanings indicated below:
BAGS
Plastic sacks designed for refuse with sufficient wall strength to maintain physical integrity when lifted by the top, securely tied at the top for collection, with a capacity not to exceed thirty-five (35) gallons and a loaded weight not to exceed thirty-five (35) pounds.
BULKY RUBBISH
Non-putrescible solid wastes consisting of combustible and/or non-combustible waste materials from dwelling units, commercial, industrial, institutional or agricultural establishments which are either too large or too heavy to be loaded in solid waste collection vehicles with safety and convenience by solid waste collectors with the equipment available therefor.
CITY
The City of Strafford, Missouri, empowered under State law to solicit and award contracts for the collection of refuse and solid waste. Will also refer to the appropriate employee or officer of the City authorized to act as its agent in handling the pertinent matter of this Chapter.
COMMERCIAL ACCOUNT
Any commercial, industrial, institutional or agricultural establishment including institutional housing and, further, other commercially oriented residential establishments, including fraternities, sororities, mobile home parks and housing families with five (5) or more dwelling units under one (1) roof.
SOLID WASTE
Garbage, refuse and other discarded materials, including, but not limited to, solid and semisolid waste materials resulting from industrial, commercial, agricultural, governmental and domestic activities, but does not include hazardous waste as defined in Sections 260.360 to 260.432, RSMo., recovered materials, overburden, rock, tailings, matte, slag or other waste material resulting from mining, milling or smelting.
TRASH CART
Wheeled plastic receptacle, leakproof and waterproof with a tight-fitting lid of nominal ninety-five-gallon capacity.

A. 
Types Of Accounts. Accounts as defined in this Section are numbered below:
1. 
Residential account is an account that contains one (1) or two (2) dwelling units under one (1) roof and not used for commercial purposes.
2. 
Multiple-housing facility account is an account that contains either three (3) or four (4) dwelling units under one (1) roof.
3. 
Residential commercial account is an account that has five (5) or more dwelling units under one (1) roof.
4. 
Non-residential commercial account is any commercial, industrial, institutional or agricultural establishment excluding residential commercial account.
5. 
Commercial account, when used, shall mean both residential and non-residential commercial accounts as noted above.
B. 
Account Regulation. Residential accounts, multiple-housing facility accounts and commercial accounts shall be regulated as follows:
1. 
If a commercial account shall fail to dispose of its solid waste and refuse properly and upon creation of a health order of litter problem and upon conviction thereof, then the City shall have the right to designate the contractor, and the owner shall pay an appropriate charge for service.
2. 
The commercial account dumpster shall be enclosed with a fence one (1) foot higher than the dumpster with a gate making it accessible to the contractor's vehicle.

A. 
Collection Containers.
1. 
Residential accounts shall use trash carts provided by the waste disposal contractor.
2. 
Multiple-housing facility accounts shall have the option of using trash carts or containers of one-yard or larger size metal or plastic containers with tight-fitting lids. No occupant shall place more solid waste in a container so that the lids shall not be able to be closed.
3. 
Residential commercial accounts shall utilize a one-yard or larger metal or plastic container with tight-fitting lids. No occupant shall place more solid waste in a container so that the lids shall not be able to be closed; provided, however, that where there is a problem locating a container as determined by the contractor and the City, then an exception on the requirement of the container may be granted by the City in writing to the owner.
4. 
Multiple-housing facility accounts or non-residential commercial accounts shall use trash carts or reusable containers of one-yard or larger size metal or plastic containers with tight-fitting lids. No occupant shall place more solid waste in a container so that the lid shall not be able to be closed.
5. 
The contractor shall be responsible for the maintenance and sanitation of all containers owned or used by the contractor. The contractor's name and telephone number shall appear on the side of all containers. Containers shall be rainproof and leakproof. Lids shall be tight-fitting and in working order. It shall be the responsibility of the contractor to maintain the containers in a sanitary condition.
B. 
Collection Frequency.
1. 
The contractor shall provide one-time-per-week collection for residential accounts at the street curb.
2. 
The contractors shall provide one-time-per-week collection for non-residential commercial accounts unless a higher frequency is required by the occupant/owner or the City. For health reasons or violations of City ordinances, the City can order the frequency of the collection increased above the minimum of once a week or the size of the container increased for multiple-housing or commercial accounts if the City so determines. If so ordered by the City, the occupant/owner shall pay the appropriate monthly charge.
C. 
Collection Hours. Hours of collection are to be from 6:30 A.M. to 5:30 P.M. Monday through Saturday. Exceptions may be made only when the contractor has reasonably determined that it is not possible to service an existing route due to unusual circumstances or upon the mutual agreement of the City and the contractor.
D. 
Collection Location. Residential collections shall be made only on streets and highways maintained by the City of Strafford, the State Highway Department or on established public throughways. Solid waste (trash) containers shall be placed on the right-of-way no later than 6:30 A.M. on the scheduled day of pickup and cannot remain on the curb in excess of twenty-four (24) hours after trash has been picked up. Bags containing solid waste shall not be placed outside the confines of any dwelling unit or weather/animal proof structure sooner than noon the day preceding the regularly scheduled collection day.
E. 
Litter. The contractor shall pick up and dispose of all refuse that has been strewn about in the contractor's performance of trash collection.
F. 
Prohibited Items. The contractor may decline to collect any containers, bags or bundles not so placed in the proper location; any container not defined in the definitions; any containers that contain sharp objects or liquids; or any solid waste not properly contained.

The collection of hazardous waste materials as determined by the United States Environmental Protection Agency and the Missouri Department of Natural Resources are not covered by this Chapter.

A. 
No person shall engage in the business of collecting, transporting, processing or disposing of solid waste within the City without first applying for and obtaining an annual license therefor from the City; provided, however, that this provision shall not apply to employees of the holder of any such license.
B. 
The contractor shall provide insurance in the minimum amounts listed below. The City shall be listed as additional insured on the policies. Failure to maintain insurance will result in revocation of license.
1. 
General liability: one million dollars ($1,000,000.00) per occurrence and two million dollars ($2,000,000.00) general aggregate.
2. 
Automobile liability: one million dollars ($1,000,000.00) combined single limit.
3. 
Excess liability: one million dollars ($1,000,000.00) each occurrence.
4. 
Workers' compensation: one million dollars ($1,000,000.00).
C. 
The contractor shall indemnify and hold harmless the City from any liability, claim, damage or cause of action which may be sustained or asserted against the City as the result, directly or in any manner, of the negligent performance or failure of performance on the part of the contractor.
D. 
The contractor shall utilize equipment that is designed expressly for the collection, compaction and transport of solid waste. The equipment shall be liquid-tight as to not allow loss of liquids or solid materials to the roadways or ground. The equipment shall be maintained in good condition to prevent the leakage of hydraulic oil, lubricants and coolants to the roadway or ground. The exhaust system of the equipment shall be maintained to minimize noise.
E. 
All solid waste collected by the contractor shall be disposed at a facility approved by the City and compliant with all regulations of the Missouri Department of Natural Resources.
F. 
Trash carts and other containers shall be labeled with the contractor's name and telephone number. Trash carts and other containers shall be maintained in good mechanical condition to be easily rolled, prevent the leakage of fluids from the container, be fitted with lids that prevent the blowing of trash from the container and maintained in a sanitary condition to prevent the attraction of flies. The mechanical or hand dumping of trash carts or other containers shall be performed in a manner that prevents the spillage or blowing of the contents. In the event the contents of the trash carts or other container are spilled or blown during the dumping operation, the contractor's personnel shall immediately pick up the spilled or blown materials.

A. 
It shall be unlawful for any person to do any of the following:
1. 
Deposit solid waste in any solid waste container other than his/her own.
2. 
Burn solid waste unless done in compliance with both the Strafford Fire Protection District laws and regulations, including, but not limited to, regulations promulgated by the Missouri Department of Natural Resources and the Missouri Air Conservation Commission.
3. 
Dispose of solid waste in any facility or location which is not approved by the City and the Missouri Department of Natural Resources.

A. 
Deposit. A security deposit of fifteen dollars ($15.00) is hereby required on all new residential trash services to be collected by the City of Strafford. This charge became effective March 1, 2002, and remains unchanged, effective October 1, 2014.
B. 
Fees. Fees are set out in Section 805.100(I) of this Code.
