A. 
The City Council of the City of Breckenridge Hills shall hold one (1) regular meeting each month on the third (3rd) Monday of each month, which meeting shall be called to order by the Mayor at 7:00 P.M. All meetings shall be held at City Hall, provided however, that the meeting place for any or all subsequent meetings may be changed at any regular Council meeting by motion properly put and carried by a majority of the Council members present and voting. When the third (3rd) Monday of any month falls on a legal holiday, the City Council may, at any regular meeting, by motion properly put and carried by a majority of the Council members present and voting, fix another day for such regular meeting.
B. 
In the event of a change of meeting place, as aforesaid, notice of the change of meeting place together with the address of the new meeting place shall be given by the City Clerk or by his/her assistant, in writing, to each member of the Council by mail directed to the last known address of each Council member and mailed at least five (5) days before the date set for such meeting.

The Mayor, upon notice in writing signed by five (5) members of the Council or on his/her own, shall call a public special meeting of the City Council, which special meeting shall be a meeting open to the public and which shall be called to order by the Mayor on the designated date at 7:00 P.M. at the regularly designated meeting place of the Council. All public special Council meetings shall be publicly announced as soon as practicable. The Mayor or the Chairman of any committee or commission of the City of Breckenridge Hills shall publicly announce at any regular meeting of such Council, commission or committee the date, time and place of any public special meeting and the general nature of the subject or subjects to be discussed thereat. In addition thereto, the City Clerk or his/her assistant shall prepare a written notice of any public special meeting setting forth the date, time and place of said meeting and the general nature of the subject or subjects to be discussed. Said written notice shall be prepared and posted as soon as practicable after the announcement of any said public special Council meeting. All public special Council meetings shall be posted and open to the public to the extent necessary and as required by Chapter 610, RSMo.

Nothing in this Chapter shall be construed to prohibit special meetings of the City Council from convening at or adjourning to places outside of the City Hall for the purpose of making inspections, viewing property or otherwise gathering information.

All members of the City Council shall be required to attend all regular and special meetings of the City Council, unless excused by the Mayor because of illness or other good and sufficient reasons.

Five (5) members of the Council shall constitute a quorum to do business. In the absence of a quorum, no action shall be taken by the Council members present, except to adjourn the meeting from day to day until a quorum be present.

A. 
The City Clerk shall prepare and provide, not later than 5:00 P.M. on the Wednesday immediately prior to the next regular public monthly meeting of the City Council, an agenda for the next said regular public monthly meeting of the City Council. Said agenda shall be available at the City Hall during regular hours and at no charge.
B. 
The City Attorney shall assist the City Clerk or his/her assistant in the preparation of said agenda and shall provide the subject matter of all bills identified in the agenda to the City Clerk or his/her assistant by not later than 12:00 P.M. of the aforesaid Wednesday.
C. 
The agenda as prepared shall be followed by the City Council of the City of Breckenridge Hills, Missouri, for the conduct of the meeting to which the agenda applies. Said agenda may be deviated from by the affirmative vote of two-thirds (2/3) of the members of the City Council present and voting at said meeting.
D. 
The form for the aforesaid agenda shall be in the form that is on file in the office of the City Clerk.

At the hour appointed for the meeting, the City Clerk shall proceed to call the roll of members and announce whether or not a quorum be present, whereupon the Mayor shall call the meeting to order.

A. 
Any order of business may be dispensed with or taken up out of its regular order, upon motion put and carried by two thirds (2/3) of members of the Council present and voting.
B. 
The provisions of this Chapter concerning "order of business" shall not apply to special meetings called for a specific purpose and at such meetings only the business specifically stated in the "notice of meetings" shall be heard or acted upon.

A. 
Residents of the City, who are not members of the City Council, may be heard orally and the meetings of the City Council shall be open for discussion under such "order", which period shall not exceed thirty (30) minutes, except by unanimous vote of the Council members. No person shall speak twice on the same subject or question until all other persons desiring to speak on the subject shall have been heard. No person shall be permitted to speak longer than five (5) minutes without the specific consent of the Mayor.
B. 
Any resident or Council member desiring to speak shall address the Mayor and obtain recognition by him/her before speaking. Any resident, so recognized by the Mayor, shall state his/her name and address the Chair before proceeding.

A. 
All meetings of the City Counsel shall be conducted in accordance with Robert's Rules of Order, excepting any such rules which are repugnant to the Constitution or laws of the State of Missouri and excepting further any such rule amended by the City Council.
B. 
At the hour appointed, the Presiding Officer, whether Mayor, the President Pro Tem or in their absence any member of the City Council chosen to Chair the meeting, shall call the Council to order. It shall be the duty of the Presiding Officer to conduct all meetings of the Council, to preserve order and decorum and to decide questions of order and procedure.
C. 
Council members shall not interrupt or try to speak to another Council member who has been recognized by the Presiding Officer and has the floor unless said Council member yields the floor and the interrupting Council member has been recognized by the Presiding Officer. Council members shall address the Chair as "Mayor" or "Mr./Ms. Mayor", "President" or "Mr./Ms. President" or "the Chair", "Mr. Chairman" or "Mrs. Chairwoman" as circumstances may require. In referring to each other Council members shall use the term "Councilman", "Councilwoman" or "Council person" as circumstances may require and the Mayor shall likewise so address Council persons.
D. 
At all times the Mayor and each Council person shall remember that meetings of the City Council are held to conduct the business of the City of Breckenridge Hills. Any issue or matter discussed at a meeting shall be germane to the business of the City. All comments made by the Mayor or any Council person shall address only the particular issue or matter being discussed. Meetings shall not be used by the Mayor or any Council person as a forum for electoral politics. The Mayor and each Council person must further be cognizant that to facilitate the business of the City, they must refrain from personal attacks of any kind or nature, they must not use profanity or any language that is abusive, demeaning or inflammatory and they must not allow disagreement over the City's business to rise from debate to the level of argument. The Mayor and each Council person are the representatives of the residents of the City of Breckenridge Hills and as such they are required to conduct themselves accordingly.
E. 
Any violation of these rules shall be enforced by the Presiding Officer, whether the Mayor, President Pro Tern or selected Council person. The Presiding Officer may take such action as is necessary or appropriate including, but not limited to, warning the speaker of any violation and requesting compliance, requesting that the speaker immediately conclude his/her comments, curtailing the speaker's opportunity to be heard by refusing to allow any further comment and upon a vote of the Council duly moved and seconded, ordering the immediate removal of the speaker from the meeting. Any action taken by the Presiding Officer, other than removal from the meeting, may be subject to appeal to the Council by a motion duly made and seconded. If the Presiding Officer fails or refuses to enforce this Section, any Council person may move for relief as provided herein and if said motion be sustained, the Presiding Officer shall implement the relief so moved.

All committees shall be appointed by the Mayor with the approval of a majority of the members of the City Council present and voting.

A. 
The style of the ordinances of the City shall be: "Be it ordained by the Council of the City of Breckenridge Hills as follows:" No ordinance shall be passed except by bill, and no bill shall become an ordinance unless on its final passage a majority of the members elected to the Council shall vote for it, and the "ayes" and "nays" be entered on the journal. Every proposed ordinance shall be introduced to the Council in writing and shall be read by title or in full two (2) times prior to passage. Both readings may occur at a single meeting of the Council. If the proposed ordinance is read by title only, copies of the proposed ordinance shall be made available for public inspection prior to the time the bill is under consideration by the Council. No bill shall become an ordinance until it shall have been signed by the Mayor, or person exercising the duties of the Mayor's office. When so signed, it shall be delivered to the Mayor for his/her approval and signature or his/her veto.

B. 
When an ordinance repealing a former ordinance, clause or provision shall itself be repealed, such repeal shall not be construed to revive such former ordinance, clause or provision unless it be expressly so provided.
C. 
All ordinances which shall become laws shall as soon as practicable after their approval or adoption be recorded in a book to be kept by the City Clerk and known as the Record of Ordinances.

A. 
Any member of the City Council may introduce a resolution at any properly called regular or public special or closed special meeting of the City Council.
B. 
All proposed resolutions shall be submitted to the City Council in written form.
C. 
Resolutions may be introduced by any Council member on any subject matter or topic not prohibited by or in conflict with the ordinances of the City of Breckenridge Hills, Missouri, and/or the laws of the State of Missouri.
D. 
Each resolution after it is introduced shall be read in its entirety at a properly called regular or public special or closed special meeting of the City Council and shall be deemed passed if approved by motion properly put and carried by a majority vote of the Council members present and voting at said meeting.
E. 
All resolutions (whether passed or not passed) shall be filed in chronological order by date of their introduction in a bound volume captioned "RESOLUTIONS" and shall be identified by a number, the first (1st) part of which shall be the last two (2) numbers of the then current calendar year, followed by a chronological number which number shall be started anew at the beginning of each calendar year.
F. 
Each passed resolution shall be signed by the Mayor and attested to by the City Clerk and sealed with the City Seal. Any resolution may be certified and/or published at direction of the City Council.
