Administration of these rules and regulations shall be the responsibility of the Mayor who shall administer, interpret and from time to time recommend to the City Council appropriate amendments in order to maintain a fair and equitable system of personnel rules and regulations.

Department heads may formulate written work rules necessary for the efficient and effective administration of their department with the approval of the City Council. These rules shall not supersede the provisions of this manual. A copy of all departmental rules and regulations shall be placed on file with the City Clerk.

The rules and regulations set forth in this manual shall be applicable to all employees of the City, except when such rules are superseded by the provisions of written employment agreements or specific legislation adopted by the State legislature or the City Council. Any reference to gender shall be construed to mean male or female. These rules and regulations are not applicable to volunteers, Reserve Police Officers or appointed and elected officials. These rules shall apply to sworn personnel.

A. 
The management of the City shall have the exclusive right:
1. 
Determine the nature, scope and definition of the City organization including: classification, selection, number, retention, promotion, reorganization, transfer, deployment, assignment, layoff, recall and scheduling of employees.
2. 
Determine the methods, means, tools and equipment and personnel by which operations are to be conducted, including the right to contract and subcontract existing and future work.
3. 
Direct employees.
4. 
Discipline, suspend, demote and/or terminate employees.
5. 
Require as a part of normal employee development that an employee fulfill the responsibility of the position and attain or maintain minimal skills of his/her classification.
6. 
Take the necessary measures to maintain optimum productivity in operations.
7. 
Determine the necessity for and assignment of overtime.
8. 
Determine the scope, priority and amount of budget allocations.
Except when conducting, either directly or indirectly, a proper investigation into matters affecting the City, no member of the City Council shall directly interfere with the conduct of any department of the City or with the duties of officers and employees of the City except at the express direction of the City Council.

A. 
The department head with the approval of the Mayor may promulgate and establish administrative rules and procedures. The Mayor shall notify the City Council of any changes in established administrative rules and procedures within thirty (30) days. These rules and procedures shall cover:
1. 
Hours of work/work schedules.
2. 
Pay periods.
3. 
Performance appraisal system.
4. 
Personnel records and reports.
5. 
Temporary work assignments and transfers.
6. 
Use of City vehicles.
7. 
Outside employment.
8. 
Seniority and impact of seniority.
9. 
Conflict of interest/code of ethics.
10. 
Safety procedures.
11. 
Job-related injury procedures.
12. 
Other related internal administrative personnel matters.
