It shall be unlawful for any person to conduct a solicitation or to conduct business as an itinerant merchant without having first applied for and received a certificate of registration issued by the City.
Applicants and holders of solicitors or itinerant merchants certificates of registration shall comply with all directions and conditions set forth in this Chapter and with all applicable laws and ordinances.
A. 
Application for a certificate of registration shall be made upon forms provided by the City Clerk. Such application shall be made at least five (5) working days prior to the commencement of a proposed period of solicitation.
B. 
A separate application is required for each solicitor or itinerant merchant conducting their activities from a separate parcel of land, building, tent, room, apartment, shop, store, structure, booth, stand or vehicle.
C. 
Charitable solicitors shall be issued one (1) certificate of registration in the name of the organization conducting the solicitation.
D. 
The applicant shall truthfully state in full the information requested on the application.
E. 
Each applicant shall pay an application fee of twenty-five dollars ($25.00), however, no charge shall be required for a charitable solicitation nor for farmers or truck gardeners selling, offering for sale or soliciting orders for any product grown, raised or produced by them.
A. 
No certificate of registration shall be issued to:
1. 
Any person who has been convicted of the commission of a felony under the laws of this State or any other State or Federal law within (5) years of the date of the application.
2. 
Any person who has been convicted of a violation of any of the provisions of this Chapter, or an ordinance of any other municipality regulating soliciting within one (1) year of the date of the application.
3. 
Any person or organization who has had a previous certificate of registration issued by the City revoked within one (1) year of the date of the application.
4. 
Charitable solicitors unless they possess a valid not-for-profit letter from the State of Missouri.
5. 
Students, parents and faculty of an educational institution that are raising funds to support an activity related to and approved by the institution unless they possess a valid letter from the institution authorizing such activity.
6. 
Itinerant merchants unless they possess a valid retail sales license issued by the State Director of Revenue as required by Section 144.083, RSMo.
B. 
The Chief of Police shall review all applications and recommend their approval or denial to the City Clerk. The Director of Planning and Zoning and the Building Commissioner shall review all applications involving the use of land or buildings and recommend the approval or denial of said applications to the City Clerk.
C. 
The City Clerk, after consideration of the application and all information obtained relative thereto, shall deny the application if the applicant does not possess the qualifications for such certificate as herein required.
A certificate of registration shall be issued for a specific period of time not to exceed thirty (30) days. Renewal of certificates shall require an additional application fee. A maximum of four (4) certificates per year shall be issued to any person or organization.
A certificate of registration shall be carried at all times by the solicitor, or itinerant merchant to whom issued when soliciting, or selling their goods in the City. If a vehicle, motor or otherwise, is used in the conduct of the business, the certificate of registration shall be displayed in a prominent place where it can be plainly seen and read from the street side portion of the operator's cab. Charitable solicitors will be issued one (1) certificate to the applicant representing the organization. The certificate of registration shall be exhibited by such solicitor or itinerant merchant whenever requested to do so by any officer of the City or by any person being solicited.
