It shall be unlawful to construct, maintain, install or enlarge
any swimming pool in the City except in compliance with all the provisions
of this Chapter.

As used in this Chapter, the following terms shall have these
prescribed meanings:
One that is located in conjunction with a single-family residence.
One that is operated by any public agency or private agency
or person offering access to the general public.
One that is located in conjunction with a multiple-family
housing project, apartment complex, motel or hotel, or is operated
for or by a homeowners' association.
A receptacle for water or an artificial pool of water having
a depth at any point of more than two (2) feet intended for the purpose
of immersion or partial immersion therein of human beings and including
all appurtenant equipment. This term shall also include spas and hot
tubs.

No portion of a swimming pool outside a building shall be located
at a distance less than eight (8) feet from any side or rear property
line or building line. Pumps, filters and pool water disinfecting
equipment shall be located at a distance not less than eight (8) feet
from any side property line.

It shall be unlawful to proceed with the construction, installation,
enlargement or alteration of any private residential swimming pool
and appurtenances within the City unless permits thereafter shall
have first been obtained from the Building Commissioner.

A.
All drawings
and plans for the construction, installation, enlargement or alteration
of any swimming pool and appurtenances shall first be presented to
the Building Commissioner for examination and approval as to proper
location and construction.
B.
All private
residential swimming pools, appurtenances, water supply and drainage
systems shall be constructed in conformity with the approved plans.

A.
New Construction In-Ground Pools. All outdoor swimming pools
shall be completely enclosed by a fence. All fence openings or points
of entry into pool area enclosure shall be equipped with gates. The
fences and gates shall be forty-eight (48) inches in height above
the grade level. All gates shall be equipped with self-closing and
self-latching devices placed at the top of the gate. Design and construction
of fence shall be approved by the Building Commissioner at the time
of issuance of building permit.
B.
New Construction Above-Ground Pools. Swimming pools constructed
above the ground either totally or partially shall be protected by
a fence at least forty-eight (48) inches high if its sidewalls or
any part of the surrounding deck area is less than forty-eight (48)
inches above grade. Should such a pool be so constructed so as to
provide by its design a forty-eight (48) inch barrier above grade
at all points on the swimming pool, no fence is needed, but access
ladders to said pools shall be so arranged as to not be accessible
when pool is not in use. Exception: Approved lock down covers may
be permitted in lieu of a barrier/fence for spas or hot tubs.

No source of water other than that secured from an approved
system shall be used in swimming pools.

The systems supplying recirculated water and makeup water to
the pool shall be constructed in conformance with the ordinances regulating
plumbing.

Pools shall be equipped with facilities for completely emptying
the pool and the discharge of the pool water shall be at a rate not
exceeding two hundred (200) gallons per minute. No direct connection
shall be made to the sanitary sewer system. Where practical, the Building
Commissioner shall require the disconnection of any existing pools
from the sanitary sewer system.

Equipment shall be provided for the disinfection of all pool
water. Any disinfection method using materials other than chlorine
compounds shall be subject to the approval of the Building Commissioner.
Disinfecting equipment installed for the use of chlorine compounds
shall have sufficient capacity to maintain a minimum free chlorine
residual of four-tenths (0.4) parts per million. The disinfection
shall be introduced into the recirculation system ahead of the filters.
Public and semi-private pools shall have a testing kit available for
measuring chlorine residual and pH. Public and semi-private pools
shall have pH in the range between 7.4 to 7.8.

All new installations shall conform to Section 500.020 of this code. The Building Commissioner shall inspect the bonding and grounding of all pools prior to any concrete work or backfilling.

B.
Steps And Ladders. Two (2) or more means of egress in the
form of steps and ladders shall be provided for all pools having a
variable depth. At least one (1) such means of egress shall be located
on a side of the pool at both the deep end and shallow end of the
pool. One (1) or more means of egress in the form of steps or ladders
shall be provided for all pools having a constant depth. Location,
design and construction of steps or ladders shall be approved by the
Building Commissioner at the time of the issuance of the building
permit. Treads of steps and ladders shall be constructed of a non-slip
material and be at least three (3) inches wide for their full length.
These steps and ladders shall have a handrail on both sides.

The fee for a permit for the erection or construction of a swimming pool shall be as specified in Section 500.040(C).

Within thirty (30) days from the passage and approval of this Chapter, all existing public or semi-private pools shall comply with Sections 515.060 — 515.130 and all existing private pools shall comply with Sections 515.060, 515.070 and 515.090. Any owner of an existing pool desiring to bring said pool into compliance with the provisions of this Chapter may obtain an inspection by the City Inspector at no charge.
