GENERAL REFERENCES
Fire prevention and building construction — See Ch. 99.
Sullivan County, New York, has implemented an enhanced 911 telephone system whereby an individual is able to dial a 911 telephone number in the event of an emergency. The Town Board of the Town of Mamakating hereby finds and determines that it is the duty of the Town of Mamakating to provide for the safety and welfare of all its residents. The Town Board further finds that the county-wide enhanced emergency response system (E-911) promotes said safety and welfare of the residents of the Town of Mamakating, and is an integral component of the success of E-911. A Town-wide uniform numbering system of all buildings and the prominent easily read display of the individual property and street address numbers will assist emergency personnel in responding efficiently and quickly to an emergency. It is, therefore, in the best interest of the public health, safety and welfare of the Town of Mamakating to enact this chapter.
As used in this chapter, the following term(s) shall have the meanings indicted:
BUILDING
The principal building or buildings on each lot, and shall not include any accessory building.
STREET OR ROAD
The street designated in the property address.
If there is more than one building on a particular lot, the Building Inspector shall be authorized to decide which building or buildings on that lot shall be numbered.
A. 
Designation of numbers. The Sullivan County E-911 Coordinator shall have authority to designate building address numbers, to designate separate numbers for buildings which have no designated street number, and to redesignate building numbers when deemed necessary.
B. 
Review of determination. Any property owner aggrieved by the determination of the Sullivan County E-911 Coordinator may seek review of that determination by the Town Board of the Town of Mamakating upon written request to the Town Supervisor setting forth the reason for seeking such review. The Town Board may uphold or modify the determination of the 911 Coordinator and such determination shall be final and binding.
A. 
It shall be the duty of every building and/or property owner in the Town of Mamakating to cause to be displayed thereon the street number of said building on the building and on a post, mailbox or other nonbuilding structure at or within 20 feet of the edge of the road surface.
B. 
The post, mailbox or other nonbuilding structure may only be used for the purposes of this chapter if it is stationed on the same side of the street as the building or premises for which the number is intended. At all times, the owner of a building shall maintain such number in compliance with the provisions of this chapter.
A. 
Residential properties (noncommercial). The figures comprising the number are to be of block Arabic type and at least four inches in height with a minimum width of 0.5 inch (12.7 millimeters) and shall be placed on the front of said building and on a post, mailbox or other nonbuilding structure of at least four feet in height and not exceeding 10 feet in height in a prominent and conspicuous place. To the maximum extent practicable, the numbers shall be displayed in such a manner as to be plainly legible and visible from the center of the street of address when facing the building at all time between sunrise and sunset. Said numbers shall not be placed on any door of a building, garage, or any other door. The color of said figures shall be in sharp contrast to the color of the background.
B. 
Multifamily and two-family residential properties shall have numbers at the entrance to each individual unit. Where an entrance serves more than one unit, the numbers at the entrance shall identify the units accessed by that entrance.
C. 
Commercial property (nonresidential). The figures comprising the number are to be of block Arabic type, reflective and at least six inches in height with a minimum width of 0.5 inch (12.7 millimeters) and shall be placed on the front of said building and on a post, mailbox or other nonbuilding structure of at least four feet in height and not exceeding 10 feet in height in a prominent and conspicuous place. To the maximum extent practicable, the numbers shall be displayed in such a manner as to be plainly legible and visible from the center of the street when facing the building at all times between sunrise and sunset. Said numbers shall not be placed on any door of a building, garage or any other door.
D. 
Determination of front. For the purpose or intent of this chapter, the front of the building shall be construed as that side of the building which faces the street of address, and the number or numbers shall be displayed on such front side of the building.
E. 
Visibility. The numbers placed on a post, mailbox or other nonbuilding structure shall be so placed that they are seen from either direction while driving on the road or street. The numbers shall not be obstructed by trees, shrubbery, porches or other extensions of the building, shoveled or plowed snow, or any other obstruction. To the maximum extent practicable, the numbers placed on the building shall be so placed that they are seen from either direction while driving on the street or road.
F. 
Number type. The displayed numbers shall be block Arabic numerals.
G. 
Color. The color of said figures shall be in sharp contrast to the color of the background.
H. 
Lighting. Wherever practicable, the numbers shall be placed near a light or other source of illumination so that the numbers may be readily seen at night.
I. 
Multiple access. In the event that more than one residence has access from a single driveway, a street number of the residence must be displayed at each located where the residence's driveway access diverges from the common access.
The display of any number other than the number authorized or assigned by the Sullivan County E-911 Coordinator is prohibited.
A. 
New subdivisions. Prior to final approval by the Planning Board, in any subdivision which has one or more private roads or proposed new Town roads the developer or owner shall propose a name of each such road. The name of all private roads and proposed new Town roads shall be approved by the Town Board prior to Planning Board approval or as a condition of final subdivision approval. The Town Board will designate, by resolution, the position or person who will notify the Sullivan County E-911 Coordinator, Town Highway Superintendent, Town Building Inspector, appropriate Fire Department, local Ambulance Corps, school bus garage and the State Police Department of the new road name and location.
B. 
Existing properties. For the purpose of Enhanced 911, any existing private road or driveway which serves three or more buildings, separate parcels and/or building lots shall be considered a private road. Such private roads shall be named by the Town Board.
C. 
Signage. The approved name of a private road and of a proposed new Town road shall be posted by a street sign at each intersection of the road. All signs shall be similar in terms of construction and character to those signs installed by the Town of Mamakating for public roadways. The private road signs shall state the name of the private road, and shall include, under the name, the words "Private Road" in smaller letters. For private roads existing and not signed at the date of adoption of this chapter, the Mamakating Highway Superintendent shall purchase and install the signs. In all new subdivisions the signs shall be installed prior to issuance of any building permits and construction of any structures, and the signs shall be paid for and installed by the owner or developer.
A. 
Noncompliance deemed a violation. The failure of any person, corporation, partnership or other entity owning a building within the Town of Mamakating to comply with the requirements of this chapter within 30 days after initial notice from the Building Inspector/Code Enforcement Officer shall be deemed a violation of this chapter.
B. 
Nonmaintenance deemed a violation. The failure of any person, corporation, partnership or other entity owning a building within the Town of Mamakating to maintain the numbers in accordance with the requirements of this chapter shall be deemed a violation of this chapter.
C. 
Service of notice. A notice of violation may be given by personal service or by certified mailing to the last known address of the owner as shown on the most recent assessment roll on file in the Assessor's office of the Town of Mamakating.
D. 
Numbering of building and property by Town. In the event of the failure, neglect or refusal of any owner and/or occupant/tenant, after notice, to comply with the requirements of this chapter, the Building Inspector may cause said building and property to be numbered in accordance with the requirements of this chapter to the extent practicable.
E. 
Report; assessment of costs. The Building Inspector shall report the cost of said numbering to the Town Board, and the Town Board shall order said cost to be levied and assessed as a lien against the property of the owner and collected in the same manner as other Town taxes. The remedy provided in these Subsections D and E shall be in addition to, and not in lieu of, the penalties provided in § 87-10.
Any person, corporation, partnership or other entity violating any of the provisions of this chapter shall, upon conviction, be guilty of a violation punishable by a fine not to exceed $250. Each calendar week or portion thereof that said violation continues shall be deemed a separate and distinct violation.
This chapter shall be enforced by the Building Inspector or Code Enforcement Officer or any other officer or employee designated by resolution of the Town Board.
