[HISTORY: Adopted by the City Council of the City of Mendota
as Ch. 2, §§ 2.01 through 2.14, of the 1998 Code. Amendments
noted where applicable.]
The City of Mendota is hereby divided into four wards, which
are designated as the First, Second, Third and Fourth, and are bounded
as follows:
A.
First Ward: all that portion of the City bounded on the south by
the center line of Washington Street starting at the intersection
of Washington Street and Main Street, thence west to the center line
of 13th Avenue, thence on the east side of the center line of 13th
Avenue to the center line of Meriden Street, thence on the north side
of the center line of Meriden Street to the west City limits, thence
north on the east side of the west City limits to the north City limits,
thence east on the south side of the north City limits to the intersection
of the Illinois Central Railroad, thence southeast on the west side
of the Illinois Central Railroad to the intersection of 16th Street,
thence east on the south side of the center line of 16th Street to
the center line of Guiles Avenue, thence south on the west side of
the center line of Guiles Avenue as extended to the place of beginning,
at the intersection of Washington Street and Main Street.
B.
Second Ward: all that portion of the City bounded on the north by
the center line of Washington Street starting at the intersection
of Washington Street and Main Street, thence west to the center line
of 13th Avenue, thence north on the west side of the center line of
13th Avenue to the center line of Meriden Street to the west City
limits, thence south on the east of the west City limits to the south
City limits, thence east on the north side of the south City limits
to the center line of the Illinois Central Railroad, thence north
on the west side of the Illinois Central Railroad to the place of
beginning, at the intersection of Washington Street and Main Street.
C.
Third Ward: all that portion of the City bounded on the north by
the center line of 7th Street beginning at the intersection of 7th
Street and the Illinois Central Railroad, thence east on the south
side of 7th Street to the center line of 1st Avenue, thence south
on the west side of the center line of 1st Avenue to the center line
of 6th Street, thence east on the south side of the center line of
6th Street to the east City limits, thence south on the west side
of the east City limits to the south City limits line, thence west
on the north side of the south City limits to the Illinois Central
Railroad, thence north on the east side of the Illinois Central Railroad
to the point of beginning, at the intersection of the Illinois Central
Railroad and 7th Street.
D.
Fourth Ward: all that portion of the City bounded on the west by
the Illinois Central Railroad starting at the intersection of 7th
Street and the Illinois Central Railroad, thence north on the east
side of the Illinois Central Railroad to the start of Guiles Avenue
then continuing on, on the east side of the center line of Guiles
Avenue to the center line of 16th Street, thence west on the north
side of the center line of 16th Street to the intersection with the
Illinois Central Railroad, thence northwest on the east side of the
Illinois Central Railroad to the City limits, thence north on the
east side of the City limits to the north City limits, thence east
on the south side of the north City limits to the east City limits
to the center line of 6th Street to the center line of 1st Avenue,
thence north on the east side of 1st Avenue to the center line of
7th Street, thence west on the north side of the center line of 7th
Street to the intersection of 7th Street and the Illinois Central
Railroad, the place of beginning.
The City Council shall consist of the Mayor and two Aldermen
from each ward. It shall be the judge of the election and qualifications
of its own members.
A.
No person
shall be eligible for the office of Alderman unless he shall be a
qualified elector and reside within the ward for which he was elected;
nor shall he be eligible if he is in arrears in the payment of any
tax or other liability due to the City; nor shall he be directly or
indirectly involved any contract whatever to which the City is a party;
nor shall he be eligible if he shall have been convicted of malfeasance,
bribery or corrupt practices or crime; nor shall he be eligible for
any office the salary of which is payable out of the City treasury,
if at the time of his appointment or election he shall be a member
of the Council; nor shall any member of the Council at the same time
hold any other office under the City government; nor shall he be,
either directly or indirectly, individually or as a member of a firm,
engaged in any business transaction (other than official) with such
City, through its Mayor or any of its authorized boards, agents or
attorneys, whereby any money is to be paid, directly or indirectly,
out of the City treasury to such member or firm; nor shall any member
of the City Council sign any bond in any case wherein the City of
Mendota is interested.
B.
No person
shall be eligible to take the oath of office for the office of Alderman
if that person is, at the time required for taking the oath of office,
in arrears in the payment of a tax or other indebtedness due to the
City or has been convicted in any court located in the United States
of any infamous crime, bribery, perjury, or other felony.
C.
If a person is a resident of the City immediately prior to the active-duty military service of that person or that person's spouse, resides anywhere outside of the City during that active duty military service, and immediately upon completion of that active duty military service is again a resident of the City, then the time during which the person resides outside the City during the active-duty military service is deemed to be time during which the person is a resident of the City for purposes of determining the residency requirement under Subsection A.
A.
All officers and appointees of the City of Mendota who are appointed
by the Mayor with the advice and consent of the City Council shall
henceforth be appointed for one-year terms, unless otherwise specified
in ordinance form. This provision shall apply to all present and future
appointees. This provision shall apply to, but shall not be limited
to, the following officers and appointees: Building Inspector, Auditors,
Park Board, Engineers, Fire Chief, Police Chief, City Physician, Ambulance
Director, ESDA Director, Public Works Superintendent, Street and Parks
Superintendent, Water Superintendent, and Wastewater Plant Manager.
B.
The Fire Chief shall be appointed from the recommendation of the
Fire Department volunteers, unless the Mayor and Council, by two-thirds
vote of the entire City Council, provide for the appointment of another
individual as Chief.
C.
If any of the provisions of this section are in conflict with any
statutory provisions enacted by the State of Illinois, the state statute
shall take precedence over this section with respect to the terms
of appointments.

The regular meetings of the Council shall be held in the Council
Chamber located at the Mendota Police Department on the first and
third Monday of each and every month, except that when said Monday
shall be a legal, observed holiday (New Year's Day, Memorial Day,
the Fourth of July or Labor Day), the Council shall meet on the day
following at the same hour. The meetings shall commence at 5:30 p.m.
Special meetings of the Council may be called by the Mayor,
or any three Aldermen, whenever in their discretion they may deem
it necessary, in which event such meeting shall be called in the following
manner: The Mayor, or three Aldermen, as the case may be, shall file,
in the City Clerk's office, a statement in writing setting forth the
object and purpose of such special meeting and directing the Clerk
to give notice of the same. Upon the filing of such statement, the
City Clerk shall cause to be served personally upon each member of
the Council, or left at his usual place of business, a notice of such
special meeting, setting forth the object and purpose thereof, and
the time of holding the same. No business other than that mentioned
in the call shall be transacted at such special meeting.
A majority of the Aldermen elected shall constitute a quorum
to do business, but a smaller number may adjourn from time to time,
and may compel the attendance of absentees.
In case of the want of quorum at any time of the Council, the
majority of the members present shall direct, or the Mayor or presiding
officer shall direct, the Marshal, or any police officer, to go out
and arrest and bring in members who are not through sickness unable
to attend. Any member who purposely absents himself from the City
to avoid attending any meeting of the Council, or being in the City
conceals himself from such officer, or refuses to be brought in when
found, shall be deemed guilty of disorderly conduct and be subject
to a fine of $50, and the Council may, with the concurrence of 2/3
of all the Aldermen elected, expel such member, in which event his
seat shall be deemed vacant and shall be filled by election as in
other cases of vacancy.
Every member of the Council shall vote on all questions in which
he is not directly and personally interested, which may be brought
before the Council for its action in such manner as to require a vote
to be taken thereon, unless such member be excused by a vote of 2/3
of all the other members present.

It shall be the duty of the Mayor, at the first regular meeting
of the Council in May of each year, or as soon thereafter as may be
possible, to appoint three standing committees of the City Council,
each to consist of at least four Aldermen, which shall be as follows:
It shall be the duty of standing committees of the Council to
keep a close watch of the affairs of their respective departments
of the City government. They shall have the general management, control
and supervision over all work and things ordered to be made or done
by the Council in their respective departments, and they shall make
a report to the Council of whatever facts may be deemed of importance.
Each committee shall promptly and thoroughly investigate and report
in writing upon all matters referred to it by the Council, and do
and perform such other and further duties as the Council may from
time to time prescribe by resolution, motion or ordinance.
Every committee of the Council, in reporting upon any subject
referred to it, shall attach to its report all papers or documents
in the possession of the committee, relative to the matter so referred.
Any report of a committee of the Council shall be deferred,
for final action thereon, to the next regular meeting of the same
after the report is made, upon the request of any two Aldermen present.
