In accordance with the East Greenwich Home Rule Charter, this article shall apply to all Town, school, park and recreation facilities and Land Trust properties owned or leased by the Town, excluding Frenchtown Park and the landfill site (now known as "Scalloptown Park"); see Articles I and II of this chapter.
All Town, school, park and recreation facilities and Land Trust properties owned or leased by the Town shall be open to the public from sunrise to sunset seven days per week, unless the facility is equipped with field lights; then the facility is open until the permitted scheduled event is concluded.
No person shall light, build or make any fire on any Town, school, park and recreation facilities and Land Trust properties owned or leased by the Town, unless a permit for such fire shall have first been issued pursuant to § 166-28.
No person shall possess or operate any motorized vehicle, off-road vehicle, all-terrain vehicle, go-cart, motorcycle or dirt bike in or upon any portion of any Town, school, park and recreation facility and Land Trust property owned or leased by the Town, unless the vehicle is a registered Rhode Island Department of Motorized Vehicles street or on-road vehicle in an established parking area during the hours of use pursuant to § 166-23. It is unlawful to leave a vehicle standing or parked in established parking areas or elsewhere in the park and recreation or Land Trust areas during hours when the site is closed. Any such vehicle shall be towed at the expense of the owner. A patron of the municipal boat ramp and overlook may park his/her vehicle after sunset. If a vehicle is to be left overnight at the municipal boat ramp and overlook, then the operator must notify the Police Department of such and provide a time frame that the vehicle will be on site. Failure to notify the Police Department will result in the vehicle being towed at the owner's expense.
No person shall discard, dump or leave any paper, cans, bottles, rubbish or debris of any kind in any Town, school, park and recreation facility and Land Trust property owned or leased by the Town.
No person shall camp overnight in any Town, school, park and recreation facility and Land Trust property owned or leased by the Town without prior approval of the Town Manager pursuant to § 166-28.
Permits may be issued by the Town Manager (only after approval by the Fire Department) for the lighting, building or making of fires in all Town, school, park and recreation facility and Land Trust property owned or leased by the Town. And the Town Manager may issue an overnight camping permit, provided the applicant is a member of a supervised organization such as the Boys Scouts, Girls Scouts, Campfire Girls, or other similar organization or group and the permit is issued for the activities of such organization or group. Permits for the use of a facility will be issued by the Parks and Recreation Director for league use of fields and court areas and for special events such as charity games, fairs or any other recognized nonprofit organization or group. Users will be required to provide documentation of the required liability insurance for the intended use. All fees associated with the permitted use will be the responsibility of the permittee.
Swimming and ice skating are prohibited on all natural bodies of water within a park.
No person shall take, pluck, injure, destroy, cut, mark or deface any tree, shrub, flower, plant, building, fence, wall, gate, monument, bridge or other property in any Town, school, park and recreation facility and Land Trust property owned or leased by the Town.
No person shall hunt, shoot or have in his possession any rifle, gun, pistol, air gun, spring gun, BB gun, or other small arms; or any bow and arrow; or any contrivance arranged to discharge shot, bullets, arrows, darts or other projectiles, or any knife over three inches in length in any Town, school, park and recreation facility and Land Trust property owned or leased by the Town. Official starts, at authorized track and field events, are exempt from this restriction.
No person shall post or otherwise affix any bill, notice, advertisement or other paper upon any structure or thing within any Town, school, park and recreation facility and Land Trust property, owned or leased by the Town, nor upon any of the gates or enclosures thereof. No person shall sell, expose for sale or give away any goods, wares or circulars in any Town, school, park and recreation facility and Land Trust property owned or leased by the Town, except by special permission of the Town Manager.
No person shall have in his possession or consume any alcoholic beverages on or in any Town, school, park and recreation facility and Land Trust property owned or leased by the Town.
An owner shall keep his/her animal leashed at all times and shall not permit such animal to be at large while on any Town, school, park and recreation facility and Land Trust property owned or leased by the Town. It shall be the duty of each person who owns, possesses or controls a dog to remove and dispose of any feces left by his/her dog on any sidewalk, street, park or other public area. No person who owns, possesses or controls such a dog shall appear with such dog on any sidewalk, street, park or other public area without means of removal of any feces left by such dog. This regulation shall not apply to a licensed dog accompanying any handicapped person who, by reason of his/her handicap, is physically unable to comply with the requirements of this section.
A. 
No person shall use, operate or offer any activity for profit on any Town, school, park and recreation facility or Land Trust property owned or leased by the Town, including but not limited to Town-owned tennis and basketball courts, without first obtaining a permit issued by the Town Manager pursuant to § 166-28.
B. 
This section shall not apply to programs and activities sponsored or organized by the Town or the School Department for the benefit of students or members of the general public, nor shall it apply to a Town resident taking a private lesson from a private instructor on Town-owned tennis or basketball courts.
Violations of provisions of this article shall be punishable as provided in Chapter 1, Article III, of the Code of the Town of East Greenwich.
