A. 
The Berkeley-NorthPark Community Improvement District is hereby created within the City as a political subdivision of the State of Missouri having the powers and purposes set forth in the amended petition, a copy of which is on file in the City offices and is incorporated herein by reference (the "CID Petition"). The District is authorized to impose a sales tax and/or a special assessment in such amounts not to exceed the rates set forth in the CID Petition. The District shall include the contiguous tracts of real estate described in Exhibit A of the CID Petition, and shall be governed by a board of directors consisting of five (5) members hereafter appointed by the Mayor with the consent of the City Council, subject to the qualifications set forth in the CID Petition.
B. 
The City hereby finds that the area described in Exhibit A, which is on file in the City offices, of the CID Petition is a "blighted area" within the meaning of Section 67.1401.2(3) of the CID Act because it has been declared blighted or found to be a blighted area pursuant to Chapter 99 of the Revised Statutes of Missouri by St. Louis County by Ordinance No. 21,949 as amended by St. Louis County Ordinance No. 22,428. The City hereby further finds that the proposed uses of the District proceeds, as provided for in the CID Petition, will serve a public purpose by remediating blight and encouraging the redevelopment of real property within the District. The District shall have such additional available powers available to community improvement districts in blighted areas as described in Section 67.1461.2 of the CID Act.
C. 
The term of the existence of the District shall be for a maximum of forty (40) years from the effective date of this Section.
D. 
The Mayor hereby appoints and the City Council hereby consents to the appointment of the Board of Directors for the District to their respective initial terms of office.
E. 
The City Clerk is hereby directed to prepare and file with the Missouri Department of Economic Development the report specified in Section 67.1421.6 of the CID Act.
F. 
The officers of the City are hereby authorized and directed to execute all documents and take such actions as they may deem necessary or advisable to carry out and perform the purposes of this Section and to make ministerial alterations, changes or additions to the documents herein approved, authorized and confirmed which they may approve, and the execution of such action shall be conclusive evidence of such necessity or advisability.
