The office of the Business Administrator is hereby established
pursuant to N.J.S.A. 40A:9-136 et seq.
The Borough Administrator shall be appointed by the Mayor with
the advice and consent of Council and the term of office shall be
served at the pleasure of the Mayor and Council.
It shall be the duty of the Borough Administrator, under the
supervision and control of the Mayor and Council, and to the extent
not prohibited by law, to:
A. Act as liaison between the Mayor and Council and all boards, departments
and officers of the Borough;
B. Direct and supervise the administration of all departments, offices
and agencies of the Borough;
C. Maintain effective communication with all Borough Officials, including
the Borough Clerk, Chief Financial Officer, Tax Collector and Assessor,
Chief of Police, Zoning Officials, Code Enforcement Officials, Fire/Rescue
Chiefs;
D. Be responsible for the maintenance of sound personnel policies and
administrative practices after consultation with the Mayor, Department
Heads and Council which shall include the administration of approved
Policies and Procedures of the Borough or as provided under Civil
Service, Title 11 of the New Jersey Statutes;
E. Recommend to the Mayor and Council appointments and, when necessary
for the good of the operation of the Borough, suspension and/or removal
of department heads and all other employees excepting the Chief of
Police, Borough Clerk, CFO and Borough Solicitor;
F. Aid in the preparation of the budget, alert and discuss with department
heads as to the submission of their portion thereof;
G. Assure that all Ordinances and Resolutions of the Borough subject
to enforcement by him/her are faithfully executed;
H. Serve as designee of each member of Council, unless otherwise directed by the Councilperson who oversees that department, to review and approve all requisition/purchase orders for goods or services in accordance with Chapter
48 of the Code of the Borough of Buena. The determination of the Borough Administrator of the need and vendor shall be final, subject to review by the CFO for certification of funds and final approval by Council. The Borough Administrator shall sign all requisition/purchase order as approved or disapproved;
I. Attend any regular or special meeting of the governing body as requested
by the Mayor, Councilperson or Borough Solicitor. The Borough Administrator
may participate in the discussion of all matters coming before Council
at regular and special meetings;
J. Keep the Mayor and Council fully advised as to the current and future
needs of the Borough and make such recommendations to them concerning
the affairs of the Borough as he/she deems desirable and/or necessary;
K. Assure that all departments of the Borough Government are at all
times responsive to the needs of the residents of the Borough of Buena;
L. Investigate all complaints regarding Borough services and after consultation
with department head and councilperson assigned to that department,
answer same and report the disposition to the Mayor and Council;
M. Assist in the receipt, investigation and interviews of all employees
relative to any grievance or disciplinary matters filed in accordance
with the Borough Policy & Procedures Manual and/or Employee Handbook;
N. Perform such other duties as may be required by the Mayor and Council.
Nothing herein contained shall derogate from the powers and
duties of the elective, appointive or other officials of the Borough
of Buena, or the Boards and Commissions thereof established pursuant
to law, nor shall the rights and tenure of any elected official be
affected.
