The Town is authorized, pursuant to § 1660, Subdivision 17, of this state's Vehicle and Traffic Law, to exclude trucks, commercial vehicles, tractors, tractor-trailer combinations, and other vehicles from highways specified by the Town Board, so long as such exclusions shall not be construed to prevent the delivery or pickup of merchandise or other property along the highways from which such vehicles are otherwise excluded. From time to time, the Town is made aware that special conditions, including preservation of highway surfaces, undue dust, noise and other annoyances to residences adjoining Town highways, and issues pertaining to safety of the traveled way, make it reasonable to conclude that oversized vehicles should be excluded from using said Town roads as a thoroughfare to and from points located off of and beyond said Town roads. This article is enacted to give the Town Board a foundation upon which to exercise its authority under Vehicle and Traffic Law § 1660, Subdivision 17.

A.
Access by trucks, commercial vehicles, tractors, tractor-trailer combinations, tractor-semitrailer combinations, or tractor-trailer- semitrailer combinations to, on and over the roadways listed on Schedule E, annexed hereto and incorporated herein, is hereby prohibited and/or limits as provided in the said Schedule E.[1]

B.
The Town Highway Superintendent shall post suitable signage on and long the streets listed on Schedule E advising of the limitations on access thereto and use thereof imposed by this section.
It shall be a violation to operate a vehicle in contravention of the limitations set forth within this article. Both the operator of the vehicle and the owner of the vehicle operated with the owner's consent shall be liable for the violation.
Violation of this article shall be an offense and shall be subject to the penalties prescribed for violation of local traffic regulations as set forth within this state's Vehicle and Traffic Law.
