The Council shall appoint an officer who shall have the title of City Manager and who shall have the powers and perform the duties provided in this Charter. No Councilman shall be appointed to such office during the term for which he shall have been elected nor within one (1) year after the expiration of his term. The City Manager shall be appointed upon the affirmative vote of at least four (4) members of the Council for an indefinite term. During his term of office, the City Manager may be removed from office upon the affirmative vote of four (4) members of the Council by a resolution of removal or suspension. If removed from office he shall receive his salary for a two (2) month period from date of removal. If suspended, he may receive such pay, if any, as decided by the Council. The City Manager shall forthwith forfeit his office upon conviction of a felony, malfeasance in office, bribery, or other corrupt practice, or of a misdemeanor involving moral turpitude.

The City Manager shall be chosen by the Council on the basis of his executive, administrative and professional qualifications, with particular reference to his training and experience in and his knowledge of municipal administration. He shall devote full time to the duties of his office. The Council may appoint an Assistant City Manager who shall perform such duties as prescribed by the City Manager and shall act as City Manager in the City Manager's absence or disability.
The City Manager or Assistant City Manager, in the City Manager's absence or disability, shall designate in writing to the City Clerk a department director to perform the duties of the City Manager if the City Manager and Assistant City Manager are disabled or absent from the City. If this has not been done, the Council shall do so.
The City Manager shall be the Chief Administrative Officer of the City and shall be responsible to the Council for the proper administration of all affairs of the City coming under his jurisdiction. To that end he shall have the power and shall be required to:

See that the laws and ordinances of the City are enforced and that all franchises granted by and all contracts with the City are faithfully kept and performed.
2. 
Appoint and, when necessary for the good of the service, remove any officer or employee of the City, except as otherwise provided by this Charter.
3. 
Attend all meetings of the Council and, insofar as possible, its committees except when the Council may be considering his removal. He shall have the right to take part in the discussion, but shall have no power to vote.
4. 
Recommend to the Council for its consideration such measures pertaining to the affairs of the City as he may deem necessary or expedient.
5. 
Keep the Council fully advised of the financial condition and future financial needs of the City.
6. 
Prepare and submit to the Council the annual budget.
7. 
Prepare and submit to the Council, within sixty (60) days after the close of each fiscal year, a complete report of the finances and administrative activities of the City for the year.
8. 
Prescribe the functions and duties of officers and employees of the City not otherwise prescribed by this Charter or by ordinance.
9. 
Perform all other duties prescribed by this Charter or required of him by the Council if not inconsistent with this Charter.
