For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
DUMPSTER
Any large metal trash bin, often emptied by a special truck.
PORTABLE STORAGE UNIT
Any container designed for the outdoor storage of personal property, which is typically rented to owners or occupants of property for their temporary use and which is delivered and removed by vehicle.
SITE
A piece, parcel, tract or plot of land occupied, or that may be occupied, by one or more buildings or uses, and their accessory buildings and accessory uses, which is generally considered to be one unified parcel.
USER
The owner or occupant of property entering into an agreement with a portable storage unit company for the placement of a portable storage unit on a site located in the municipality.
Portable storage units and/or dumpsters may be temporarily located in single-family, multiple-family and/or commercial zoning districts, so long as they shall be placed only in the driveway, allotted parking spaces on property, are not located in the right-of-way and do not obstruct the sidewalk.
The portable storage unit shall be no larger than 130 square feet in area and no higher than 10 feet from grade.
A. 
A site permit is required for the placement of a portable storage unit and/or dumpster. The owner/occupant of the site must reapply for a site permit should the portable storage unit remain at the site for any time period greater than 30 days. Application for the site permit shall be made to the Borough by the owner/occupant on a form provided for by the Borough.
B. 
A site permit may be issued to allow the placement of the portable storage unit and/or dumpster at the site for an additional 30 days following the initial thirty-day period provided for in Subsection A of this section.
C. 
A portable storage unit and/or dumpster shall have no signage other than the name, address and telephone number of the person or firm engaged in the business of renting or otherwise placing the portable storage unit and/or dumpster. The sign must be permanently adhered to or be painted on the portable storage unit and/or dumpster.
D. 
Portable storage unit and/or dumpster permits will not be granted to any user who is found to be in violation of the regulations of this article until such violation is abated.
E. 
The cost of the permit shall be $100 for each thirty-day period. The portable storage unit and/or dumpster shall not remain at a site longer than a period of 60 days.[1]

F. 
Users are limited to a maximum of three site permits per calendar year, upon the applicant demonstrating to the satisfaction of the Borough that the user of the portable storage unit and/or dumpster does not currently hold a site permit for portable storage units and/or dumpsters and that the specific location and site have sufficient space to place the portable storage unit and/or dumpster as well as continue to provide adequate parking, public safety access and compliance with all health, safety and welfare rules and regulations.
A. 
The portable storage unit and/or dumpster company shall be responsible to ensure that the portable storage unit and/or dumpster is in good condition, free from evidence of deterioration, weathering, discoloration, rust, ripping, tearing, or other holes or breaks.
B. 
When not in use, the portable storage unit shall be kept locked.
C. 
The user of any site on which a portable storage unit is placed shall also be responsible for ensuring that no hazardous substances are stored or kept within the portable storage units.
A. 
It shall be unlawful for any person to allow a portable storage unit and/or dumpster to remain on a site which he or she owns, rents, occupies or controls without first obtaining a site permit from the Borough.
B. 
A user who allows a portable storage unit to remain at a site without first obtaining a site permit as required by this article shall be provided a grace period of two days from the placement of the portable storage unit and/or dumpster to remove the portable storage unit and/or dumpster or to obtain a site permit.
C. 
Should a user in violation of the regulations of this article fail to obtain a permit or remove the portable storage unit and/or dumpster at the termination of the grace period, the user shall be deemed to be in violation of this article.
D. 
It shall be unlawful for a portable storage unit and/or dumpster to remain at a site in excess of the time periods permitted under this article. Each day that any such portable storage unit and/or dumpster remains at a site in violation of the provisions of this article shall constitute a separate violation.
