Notwithstanding the provisions of Section 5.4.3 of the Subdivision
Ordinance of the Village of Homer Glen, except as hereinafter set
forth, no construction activity shall occur on any site within the
Village without the owner or applicant having first obtained a site
development permit or other building permit from the Village. No site
development permit shall be issued by the Village unless a final plat
has been approved for the site and final engineering plans have been
approved by the Village Engineer. In the event that a final plat is
not required in connection with the development of the site, no site
development permit or other building permit shall be issued by the
Village unless final engineering plans have been approved by the Village
Engineer.
For purposes of interpreting this article, "construction activities"
shall not include design-related activities such as surveying (provided
the condition of the site is left undisturbed), or the taking of soil
borings (provided any disturbance to the condition of the site is
limited to the immediate area surrounding the boring locations), but
shall include activities such as clearing (including but not limited
to tree removal), grubbing, stockpiling (of topsoil, clay, sand, aggregate
or other similar materials), excavation, filling, paving, demolition,
construction, redevelopment, reconstruction, and any other activity
that might alter the magnitude, frequency, deviation, direction, or
velocity of stormwater flows from a property. Construction activity
shall not be deemed to include the delivery to the site of equipment
or other manufactured pipe product or accessory (but specifically
excluding topsoil, clay, sand, aggregate or other similar naturally
occurring earthen materials) to be used in connection with proposed
improvements on the site, provided:
A. The site is not disturbed but for the unloading of said equipment
or material;
B. The equipment or other product is unloaded and temporarily stored
in an area on the site which has been previously approved by the Village
for the unloading and temporary storage of such equipment and material;
C. Soil and erosion control measures have been implemented surrounding
the area in which the equipment or other product is unloaded and temporarily
stored; and
D. Unless construction has commenced in accordance with the ordinances
of the Village, such equipment and material shall not be stored on
the site for more than two weeks.
The provisions of this article shall not apply to the construction
of a single-family dwelling unit or addition thereto on a site or
parcel of land which has not been subdivided.
