[HISTORY: Adopted by the Mayor and Council of the Borough of Wood-Ridge 12-26-1975 by Ord. No. 700 as § 2-3 of the 1975 Revised General Ordinances (Ch. 21 of the 1986 Code); amended in its entirety 11-30-2022 by Ord. No. 2022-10. Amendments noted where applicable.]
A. 
There shall be a Municipal Court in the Borough pursuant to N.J.S.A. 2B:12-1 et seq., to be known as the "Municipal Court of the Borough of Wood-Ridge." The Municipal Court shall have a Seal bearing the impress of the name of the Court. Court sessions shall be held in the Council Chambers.
B. 
Any and/or all of the provisions of this chapter may be satisfied through the adoption by the Mayor and Borough Council of an interlocal services agreement, shared services agreement, or consolidated joint municipal court agreement with one or more other municipalities.
There shall be a Judge of the Municipal Court who shall be appointed by the Mayor, with the advice and consent of the Borough Council, and who shall receive a salary as determined by the annual salary ordinance and resolution. The Judge shall serve for a term of three years from the date of appointment and until a successor is appointed and qualified. A vacancy not caused by the expiration of the term shall be filled for the remainder of the unexpired term.
The Municipal Court and the Municipal Court Judge shall have, possess and exercise all the functions, powers, duties and jurisdiction conferred by state law.
There shall be an Administrator of the Municipal Court, who shall be appointed by the Mayor, with the advice and consent of the Borough Council, and who shall receive a salary as determined by the annual salary ordinance and resolution. The Municipal Court Administrator shall perform all functions and duties as prescribed by law, by the rules applicable to municipal courts, by the Municipal Court Judge, and by the Bergen County Municipal Presiding Judge and/or Bergen County Municipal Division Manager.
There may be any number of Violations Clerks of the Municipal Court, as may be determined by the Mayor and Borough Council, who shall be appointed by the Mayor, with the advice and consent of the Borough Council, and who shall receive a salary as determined by the annual salary ordinance and resolution. The Violations Clerk or Clerks shall work under the direction of the Municipal Court Administrator and shall perform such functions and duties as required by the Municipal Court Administrator and/or the Municipal Court Judge.

There shall be a Prosecutor of the Municipal Court and such other Alternate and/or Assistant Prosecutors, as may be determined by the Mayor and Borough Council, who shall be appointed by the Mayor, with the advice and consent of the Borough Council, and who shall receive a salary as determined by the annual salary ordinance and resolution.
B. 
The term of office of the Prosecutor and any Alternate or Assistant Prosecutors shall be one year from January 1 to December 31. The filling of any vacancies shall be for the remainder of the unexpired term.
C. 
The Prosecutor, and any Alternate or Assistant Prosecutors, shall be an attorney in good standing licensed to practice law in the State of New Jersey.
D. 
The powers and duties of the Prosecutor, and any Alternate or Assistant Prosecutors, shall be as established by state law and/or the directives of the County Prosecutor.

There shall be a Public Defender of the Municipal Court and such other Alternate and/or Assistant Public Defenders, as may be determined by the Mayor and Borough Council, who shall be appointed by the Mayor, with the advice and consent of the Borough Council, and who shall receive a salary as determined by the annual salary ordinance and resolution.
B. 
The term of office of the Public Defender, and any Alternate and/or Assistant Public Defenders, shall be one year from January 1 to December 31. The filling of any vacancies shall be for the remainder of the unexpired term.
C. 
The Public Defender, and any Alternate and/or Assistant Public Defenders, shall be an attorney in good standing licensed to practice law in the State of New Jersey.
D. 
The powers and duties of the Public Defender and any Alternate and/or Assistant Public Defenders shall be as established by state law.
E. 
The determination of a defendant's eligibility to be represented by the Public Defender and of any fees or costs to be paid by the defendant for said representation shall be governed by state law and/or rules and policies of the New Jersey Court System.
