A.
There
shall be a Borough Engineer, pursuant to N.J.S.A. 40A:9-140 et seq.,
who shall be appointed by the Mayor, with the advice and consent of
the Borough Council, for a term of one year from January 1 to December
31. Filling a vacancy shall be for the remainder of the unexpired
term. The Borough Engineer shall be a licensed by the State of New
Jersey as a professional engineer, but need not be a resident of the
Borough. The Borough Engineer shall be authorized to utilize engineers
and employees of the Borough Engineer's engineering firm in the performance
of the duties of the office of Borough Engineer. In the case of performing
and/or providing surveys of properties, the Borough Engineer or a
member or employee of the Borough Engineer's firm shall be a land
surveyor licensed by the State of New Jersey.
B.
In lieu
of appointing an individual to be the Borough Engineer, the Mayor
and Borough Council may appoint an engineering firm to perform the
duties of Borough Engineer, provided that the principal engineers
of the firm shall be licensed by the State of New Jersey as professional
engineers.
C.
The Borough
Engineer or the Borough Engineer's engineering firm shall be paid
such retainer, fees, and compensation for services rendered as may
be agreed upon and authorized by the Mayor and Borough Council. Said
retainer, fees, and compensation shall be paid upon submission of
a claim in accordance with the Borough's policies and procedures for
payment of claims.
D.
The Mayor
and Council may appoint any such engineers or engineering firms as
may be required to serve as special engineer to the Borough to provide
any specialized engineering disciplines needed by the Borough. Any
and all engineers or engineering firms providing special engineering
services shall possess the same qualifications and be compensated
in the same manner as that of the Borough Engineer who shall coordinate
and monitor the work and activities of all special engineers.

by state law and Borough ordinance and, in addition, shall:
