A.
Every person, firm or corporation engaged in the business of constructing,
erecting, altering, repairing, restoring, reroofing, re-siding, demolishing,
or moving the whole or part of any building or structure, or engaged
in the business of the construction and installation of swimming pools
or signs, shall be required to register with the Construction Code
Official.
B.
The owner or occupant of a building or structure applying for a building
permit shall not be required to register, provided that he intends
to do and supervise his own work.
Applications for the registration of contractors shall be submitted
to the Construction Code Official on forms supplied by him and shall
include the name of the contractor, address, phone number and registered
agent, if any. The application shall also contain the number of years
such person, firm or corporation has been in business or in existence
at the current location or any prior location, as well as information
regarding types of insurance maintained and the names of insurers.
The annual fee for registration for all contractors shall be
$25, which registration shall expire on December 31.
A.
All work shall be done in accordance with the State Uniform Construction
Code, N.J.S.A. 52:27D-119 et seq., and must be done in a good and
workmanlike manner.
B.
After obtaining a building permit, the person or persons doing the
work shall notify the Construction Code Official 24 hours prior to
commencing any work whatsoever on any building or structure.
No permit shall be issued by the Construction Code Official
of the Borough of Wood-Ridge to anyone except a licensed contractor
or his duly authorized agent under the provisions of this chapter,
except to actual owners or occupants who intend to do the work themselves.
The Construction Code Official shall revoke the registration
of any contractor licensed hereunder who shall be guilty of any one
or more of the following acts or omissions:
A.
Fraud or misrepresentation as determined by a court of competent
jurisdiction.
B.
Fraud or misrepresentation upon the application for registration
submitted in accordance herewith.
C.
Failure to secure necessary permits or violation of the Uniform Construction
Code or other Borough ordinance, regulations or state statutes and/or
industry standards.
D.
By the filing of a Chapter 7 petition for bankruptcy, whether voluntary or involuntary, or upon the appointment by the court of competent jurisdiction of a receiver.
E.
Failure to maintain required liability insurance.
Any person aggrieved by the action of the Construction Code
Official shall have the right to appeal to the Mayor and Council.
Such appeals shall be taken by filing with the Borough Clerk, within
10 days after notice of revocation, a written statement setting forth
fully the grounds for appeal. The Mayor and Council shall thereafter
set a time and place for hearing the appeal upon at least seven days'
prior notice to the appellant. The decision of the Mayor and Council
on such appeal shall be final.
Whenever notice is required to be given by any section of this
chapter, such notice may be effected by personal service upon any
principal or agent of the registered contractor or by certified mail
to the last address listed in the Construction Code Official's
office, listed in connection with the registration information.
Any person or persons or their agents, servants or employees
who shall violate any of the provisions of this chapter shall, upon
conviction thereof in the Municipal Court of the Borough of Wood-Ridge,
be subject to a fine of not less than $100 nor more than $500. Every
day that such person or persons or their agents, servants or employees
shall fail to comply with the provisions of this chapter shall constitute
a separate and additional offense against the provisions thereof.
