No person shall use any vacant lot, open space or temporary structure within the Borough for the purpose of engaging in the business of selling, trading, exchanging, displaying or storing for sale used or secondhand motor vehicles without first obtaining a license therefor from the Borough Council.
A. 
All applications for a license under this article shall be filed with the Borough Clerk and, in addition to the requirements of § 343-2, shall include the block and lot number of the proposed premises as shown on the Wood-Ridge Assessment Map current at the time of application and the dimensions of the land upon which the business is to be conducted. In all cases where the applicant is not the owner of the site of the proposed business, the owner's consent in writing shall be endorsed on the application.
B. 
Upon receipt of the application, accompanied by the license fee, it shall be referred to the Chief of Police and the Chief of the Fire Department for their respective recommendations as to possible police and fire hazards. Upon receipt of such recommendations, the Borough Clerk shall refer the application to the Council.
A. 
All licenses issued hereunder shall be authorized by resolution of the Borough Council. The Borough Council, in considering the application, shall take into consideration:
(1) 
The nature and development of the surrounding property.
(2) 
The proximity of churches, schools, public buildings or other places of public gathering.
(3) 
The effect such business may have upon traffic conditions in the Borough and the creation of traffic hazards.
(4) 
The sufficiency in number of such other businesses of the same character in the Borough.
(5) 
The health, safety and general welfare of the public.
(6) 
The suitability of the applicant to establish, maintain and operate such business and to receive a license therefor.
B. 
All licenses granted by the Borough Council shall be issued by the Borough Clerk. In the event that any application is refused or denied, the Borough Clerk shall forthwith return the fee to the applicant.
All such licenses shall expire on June 30 of each year, and there shall be no apportionment of any fee for any portion of the year.
The license shall not be assignable or transferable and shall authorize the licensee to conduct the business on the specified premises only.

The annual license fee shall be the sum of $500 for up to 10,000 square feet area and $700 for 10,000 square feet or more.
In any subsequent license renewal, it shall suffice for the applicant to certify under oath all substantial and material changes, if any, as set forth in the original application, provided that the application for renewal is made prior to expiration of the current license.
Under the license issued under this article:
A. 
No motor vehicle shall be exhibited, stored, parked, kept or located on any street, sidewalk or part thereof.
B. 
No motor vehicle shall be exhibited, stored, parked or located for the purpose of selling, trading, exchanging or displaying the same within 150 feet of any building occupied as a residence.

Any violation of the provisions of this article shall be punishable as provided in Chapter 1, General Provisions, Article II.
