Township of Toms River, NJ Article III Smoking Prohibited on Town Hall Campus

§ 433-11 Where prohibited; exceptions.

A. Smoking, as defined in § 433-1, is hereby prohibited in the geographic area encompassing Town Hall and the Township Parking Garage, including Wilsey Way, within the following boundaries: Washington Street to the north, Water Street to the south, the Ocean County Library and Horner Street to the east, and Robbins Street to the west. Excluded from this prohibition are public sidewalks running along, or any private property located within or along, those boundaries.

B. Designated smoking areas, not to exceed three, may be provided within the prohibited area. If established, these areas will be at least 25 feet from Town Hall and equipped with proper refuse containers.

§ 433-12 Posting of signs.

Signs shall be posted at various points conspicuously identifying the prohibited smoking area, defined pursuant to § 433-11A and any designated smoking areas established.

§ 433-13 Violations and penalties.

A. Violators are subject to a fine not to exceed $100 for the first offense and not to exceed $200 for any subsequent offense.

B. The Toms River Township Municipal Court is vested with jurisdiction to adjudicate violations of this article.
