Any person, other than the City of Pacific or any other governmental taxing authority within the City, owning an alarm system that is connected to the alarm board in the Police Department of the City shall pay a fee of ten dollars ($10.00) per month to the City Collector and receive a receipt therefor.

A. 
Definitions. The following words shall have the meanings set out below, when used in this Section:
ANNUNCIATOR
The instrumentation of an alarm console at the receiving terminal of a signal line which, through visual and/or audible signals, shows when an alarm device at a particular location has been activated or it may also indicate line trouble.
DAY ALARM SYSTEMS
Any mechanical or electric device which is designed to activate manually or automatically upon the presence of a hazard requiring urgent attention of any emergency service.
FALSE ALARM
Activation of emergency alarm system intentionally or by inadvertence, negligence or of unintentional act to which any Police Department responds, including activation caused by the malfunction of the emergency alarm system.
B. 
All false alarms to which any City department responds or which any City of Pacific Police respond, other than a false alarm of premises occupied by the City of Pacific or any other governmental taxing authority within the City, shall result in the following warnings or fines to the alarm user or owner:
1. 
A warning for the first two (2) false alarms in any calendar year.
2. 
Third (3rd) and subsequent false alarms in any calendar year shall constitute a misdemeanor and be punishable by a fine of up to seventy-five dollars ($75.00).
Whereupon, the determination by the Police Department that a false alarm has occurred shall be sent to the alarm user or owner notifying the alarm user or owner of the determination of false alarm and directing payment within thirty (30) days of any fine that may be due, payable to the City Collector. For refusal to pay such service charge within thirty (30) days of notice shall constitute a violation of this Section and the alarm user or owner shall be prosecuted in the Municipal Court of the City of Pacific with the alarm user/owner having the burden of proof that the service charge is improperly imposed.
C. 
The following shall not be considered false alarms:
1. 
When the department determines that the alarm has been caused by a malfunction of the indicators at the alarm dispatching agency.
2. 
When the Police Department determines that the alarm has been caused by damage, testing or repair of the telephone equipment or lines by the telephone company, provided that such incidents are promptly reported to the telephone company.
3. 
When an alarm is intentionally caused by an occupant or resident acting under a reasonable belief that a need exists to call the Police Department.

A fee shall be charged for the furnishing of any copy of a Police report as follows:
For the first (1st) page: $5.00.
For each additional page: $1.00.
