The name of the commission described in this division is the Fredericksburg Arts Commission.

A. 
The purpose of the Fredericksburg Arts Commission shall be to provide leadership by and for City government in supporting arts and cultural affairs. The duties of the arts commission shall be as follows: to advise the City Council on matters pertaining to artistic, aesthetic, and cultural aspects of the City; to recommend City programs and policies that develop and promote artistic excellence in the community; to encourage and develop art activities of individuals, organizations, and government agencies within the City; to receive funds in support of the arts community; to make grants in support of the arts; to plan and promote public art; and to promote art education and awareness.
B. 
The City's finance department shall act as fiscal agent for the commission. The commission shall not have the power to make independent purchases of goods or services; any such purchase shall be accomplished through the City, pursuant to applicable procurement laws and policies. The unspent remainder of grants and donations received by the commission shall not revert to the general fund at the end of the fiscal year.

A. 
The Fredericksburg Arts Commission shall be appointed by the City Council and shall be composed of up to 11 members. Nominations for four members shall be solicited from organizations existing within the City which develop projects in the arts: such as non-profit organizations, City schools or university arts faculty, and other art organizations.
B. 
Two members shall be members of the City Council.

C. 
The remaining members of the commission shall be at-large members.
D. 
At-large members of the Fredericksburg Arts Commission need not be residents of the City, but non-residents must maintain an art studio or place of business related to the arts within the City.
E. 
The members of the Fredericksburg Arts Commission who are City Council members shall serve at the pleasure of the City Council. Two of the members representing non-profit organizations and two of the at-large members shall be appointed to an initial term of two years each. The remaining members of the commission shall be appointed for an initial term of four years each. At the conclusion of these initial terms, members of the fine arts commission shall thereafter serve terms of four years each.

F. 
Any appointed member of the Fredericksburg Arts Commission may be removed by the City Council for inefficiency, lack of participation, neglect of duty, or malfeasance in office.

The Fredericksburg Arts Commission is hereby authorized to set out is own bylaws, procedures and rules for the accomplishment of the purposes designated by this division, subject to approval by City Council. A written report shall be submitted annually to the City Council not later than December 31, outlining the commission's accomplishments and problems of the past year and setting forth its plans and proposals for the upcoming calendar year.
