No person shall operate a motor vehicle or tractor upon any sidewalk in the Borough, nor shall any person operate a motor vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley at such locations where the curb, if such sidewalk is curbed, shall have been properly cut down for the purpose. Any person who shall violate any provision of this section shall, upon conviction thereof, be punishable as provided in Article X, Violations and Penalties, of this chapter.

Any person who shall operate a motor vehicle or tractor upon any highway or portion thereof hereby established as a one-way highway other than in the direction hereby established for traffic thereon shall, upon conviction thereof, be punishable as provided in Article X, Violations and Penalties, of this chapter.
It shall be unlawful for the operator of any vehicle or tractor to make a U-turn anywhere upon any highway in the Borough. Any person who shall violate any provision of this section shall, upon conviction thereof, be punishable as provided in Article X, Violations and Penalties, of this chapter.
A.
The following highways are hereby established as through highways,
and the operator of every vehicle or tractor upon approaching any
such highway at any intersection thereof (except for such intersections
where there are now or shall hereafter be located official traffic
signals) shall come to a full stop, within a reasonable distance,

A.
It shall be unlawful for any person to operate any motor vehicle
or other vehicle, tractor, trailer, or tractor-trailer combination,
having a gross weight in excess of 12,000 pounds, on any highway in
the Borough of Burgettstown, except that portion of Shady Avenue extending
100 feet west of the western end of the bridge crossing Raccoon Creek.
B.
Any person who shall violate any provision of this section shall,
upon conviction thereof, be punishable as provided in 75 Pa.C.S.A.
§ 4902(g)(1), provided that this section shall not apply
to any of the following:

(1)
Buses
or commercial motor vehicles transporting passengers for compensation
which operate locally within the limits of the Borough and regularly
receive and discharge passengers at specified locations in the Borough;
(2)
Vehicles
of any fire company;
(3)
Vehicles
for any public utility work;
(4)
Vehicles
making local deliveries or rendering service to occupants of buildings
or for other reasons on any of the highways of the Borough; or
(5)
Any
vehicle owned by or performing work for the United States of America,
the Commonwealth of Pennsylvania or any political subdivision thereof.
C.
Any entity or person that owns and/or operates a motor vehicle that
has a gross weight (including load) in excess of 10 tons may obtain
an annual permit from the Borough to operate said vehicle on the restricted
portion of Center Avenue by paying an application fee of $350 per
vehicle. Upon receiving a permit from the Borough, the owner and/or
operator must at all times display the permit in the vehicle in question
and/or any and all vehicles for which a permit is obtained and must
make it readily available to any law enforcement officer upon request.
A separate permit and application fee must be obtained and paid for
each vehicle that the owner and/or operator desires to use on the
restricted portion of Center Avenue. The application must include
the following: name and address of the owner; a designation as to
the make and model of the subject vehicle; its vehicle identification
number; and its license plate number. If any of the same should change
during the term of the annual permit, updated information must be
provided to the Borough. All permit fees received by the Borough shall
be allocated by the Borough for the sole purpose of paying the expenses
related to the maintenance of Center Avenue. The user shall enter
into an excess maintenance agreement with the Borough and be subject
to and abide by its terms and conditions (a copy of the same being
attached hereto and made a part hereof).

It shall be unlawful for any person to operate any vehicle or tractor upon any highway in the Borough that is under construction, resurfacing or repair, in disregard of any official sign, barricade or notice that the same is closed to vehicular traffic. Any person who shall violate any provision of this section shall, upon conviction thereof, be punishable as provided in Article X, Violations and Penalties, of this chapter.[1]

A.
No gasoline-powered or diesel-powered motor vehicle shall be operated
on any highways, streets, avenues, alleys and boulevards, etc., within
Burgettstown Borough, utilizing, in said operation, an engine brake
retarder without exhaust mufflers or with defective or modified exhaust
mufflers permitting excessive noise to be created by said motor vehicle
through the use of the engine brake retarder.
B.
The above provisions notwithstanding, the restrictions set forth
herein shall not apply to any of the following conditions:

herein shall also not apply to emergency driving situations requiring
the utilization of an engine brake retarder to protect the safety
and property of the residents of the Borough, other motor vehicle
operators and passengers, and pedestrians.
D.
Signs shall be posted within the Borough in appropriate places advising
motor vehicle operators of the boundary where prohibition of the use
of engine brake retarders, as contained herein, commences. A sign
must also be posted at the point where trucks may start to use brake
retarders again, reading "End Brake Retarder Prohibition."
E.
Any person, persons, firm, corporation, or organization violating
any of the provisions of this chapter shall, upon summary conviction
before a District Judge having jurisdiction, be sentenced to pay a
fine of $300 and costs of prosecution and, in default of the payment
thereof, shall be sentenced to undergo imprisonment for a period not
to exceed 10 days.
